Synopsis: School instructional time. Increases the number of student
instructional days from 180 to 183. Provides that the definition of
student instructional time includes up to three student instructional
days each school year for use as professional development time.
Provides that a school year for grades 1 through 6 consists of at least
54,900 minutes. Provides that a school year for grades 7 through 12
consists of at least 65,880 minutes. Makes corresponding changes to
related sections.
Effective: July 1, 2012.

A BILL FOR AN ACT to amend the Indiana Code concerning
education.
SECTION 1. IC 20-30-2-1, AS ADDED BY P.L.1-2005, SECTION
14, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE JULY 1,
2012]: Sec. 1. As used in this chapter, "instructional time" is means:
(1) time during which students are participating in:
(1) (A) an approved course;
(2) (B) a curriculum; or
(3) (C) an educationally related activity;
under the direction of a teacher, including a reasonable amount of
passing time between classes. Instructional time does not include
lunch or recess; and
(2) time used for professional development activities that does
not exceed:
(A) for grades 1 through 6, nine hundred (900) minutes;
(B) for grades 7 through 12, one thousand eighty (1,080)
minutes; and
(C) for a school flex program under section 2.2 of this
chapter, five hundred forty (540) minutes;
in a single school year.
(b) Except as provided in subsection
(1) fifty-four thousand nine hundred (54,900) minutes for grades 1 through 6; and
(2) sixty-five thousand eight hundred eighty (65,880) minutes for grades 7 through 12;
of instructional time. Not later than June 15 of each school year, the superintendent of each school corporation shall certify to the department the
STEP ONE:
(A) the amount of the total tuition support allocated to the school corporation for the particular school year;
(B) the current ADM (as defined in IC 20-43-1-10) for the school corporation.
STEP TWO: Multiply:
(A) the STEP ONE amount; by
(B) the number of students included in the school corporation's current ADM who are in grades 1 through 6.
STEP THREE: Divide:
(A) The STEP TWO amount; by
(B) fifty-four thousand nine hundred (54,900).

STEP FIVE: Multiply the quotient determined under STEP
(b) If a school corporation fails to conduct the minimum amount of instructional time for grades 7 through 12 during a school year as required under section 3 of this chapter, the department shall reduce the August tuition support distribution to that school corporation for a school year by an amount determined as follows:
STEP ONE: Divide:
(A) the amount of the total tuition support allocated to the school corporation for the particular school year; by
(B) the current ADM (as defined in IC 20-43-1-10) for the school corporation.
STEP TWO: Multiply:
(A) the STEP ONE amount; by
(B) the number of students included in the school corporation's current ADM who are in grades 7 through 12.
STEP THREE: Divide:
(A) The STEP TWO amount; by
(B) sixty-five thousand eight hundred eighty (65,880).
STEP FOUR: Subtract the amount of instructional time, expressed in minutes, that the school corporation conducted from sixty-five thousand eight hundred eighty (65,880).
STEP FIVE: Multiply the quotient determined under STEP THREE by the number determined under STEP FOUR.
(1) the school corporation applies to the department for a waiver of the penalty imposed under section 4 of this chapter for a specific

(1) is enrolled in a public school and a nonpublic school;
(2) has legal settlement in a school corporation; and
(3) receives instructional services from the school corporation.
(b) For purposes of this section, full-time equivalency is calculated as follows:
STEP ONE: Determine the result of:
(A) the number of days instructional services will be provided to the pupil, not to exceed one hundred eighty
(B) one hundred eighty
STEP TWO: Determine the result of:
(A) the pupil's public school instructional time (as defined in IC 20-30-2-1); divided by
(B) the actual public school regular instructional day (as defined in IC 20-30-2-2).
STEP THREE: Determine the result of:
(A) the STEP ONE result; multiplied by
(B) the STEP TWO result.
STEP FOUR: Determine the lesser of one (1) or the result of:
(A) the STEP THREE result; multiplied by
(B) one and five hundredths (1.05).
