    A BILL FOR AN ACT to amend the Indiana Code concerning professions and occupations.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 25-42; (12)IN1257.1.1. -->     SECTION 1. IC 25-42 IS ADDED TO THE INDIANA CODE AS A NEW ARTICLE TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2012]:
     ARTICLE 42. HIGH PRESSURE BOILER OPERATORS
    Chapter 1. Definitions
    Sec. 1. As used in this article, "board" refers to the boiler and pressure vessel rules board established by IC 22-12-4-1.
    Sec. 2. As used in this article, "boiler horsepower" means the power required to evaporate thirty-four and five-tenths (34.5) pounds of water at two hundred twelve degrees Fahrenheit (212°F) in one (1) hour. One (1) boiler horsepower unit equals a boiler thermal output of thirty-three thousand four hundred seventy-five British Thermal Units per hour (33,475 BTU/h).
    Sec. 3. As used in this article, "high pressure boiler" means a boiler with:
        (1) a maximum allowable working pressure of at least fifteen (15) pounds per square inch (psi); and
        (2) more than six (6) boiler horsepower.
    Sec. 4. As used in this article, "licensing agency" means the Indiana professional licensing agency established by IC 25-1-5-3.
    Sec. 5. As used in this article, "NIULPE" refers to the National Institute for the Uniform Licensing of Power Engineers.
    Chapter 2. Certification of High Pressure Boiler Operators
    Sec. 1. An individual who operates a high pressure boiler must:
        (1) be certified as a high pressure boiler operator by the board; and
        (2) either:
            (A) hold and maintain a high pressure boiler operator license issued by NIULPE; or
            (B) work under the direct supervision of a high pressure boiler operator licensed by NIULPE.
    Sec. 2. An individual who knowingly, recklessly, or intentionally violates section 1 of this chapter commits a Class C infraction.
    Sec. 3. (a) An individual who applies for a high pressure boiler operator certificate must demonstrate that the individual holds a valid high pressure boiler operator license issued by NIULPE.
    (b) An application for a certificate issued under this section must be:
        (1) made to the board in the form and manner provided by the board; and
        (2) accompanied by an application fee in the amount set by the board.
    Sec. 4. A certificate issued by the board expires on the earlier of the following dates:
        (1) Two (2) years from the date of issuance.
        (2) The expiration date of the NIULPE license issued to the certificate holder.
    Sec. 5. An individual who applies to renew a certificate issued under this chapter must:
        (1) apply for renewal in the manner required by the board;
        (2) pay a renewal fee established by the board; and
        (3) demonstrate that the individual holds a valid high pressure boiler operator license issued by NIULPE.
    Sec. 6. (a) IC 4-21.5 governs the board's procedures for conducting hearings and issuing subpoenas for witnesses and other evidence.
    (b) An applicant who is aggrieved by an order or determination of the board under this chapter is entitled to a judicial review under IC 4-21.5.
    Sec. 7. The licensing agency shall provide staff and support to the board to perform the board's duties under this chapter.
    Sec. 8. The licensing agency shall receive and account for all money collected under this chapter and shall deposit the money with the treasurer of state, who shall deposit the money in the state general fund.
    Sec. 9. The board may adopt rules under IC 4-22-2 needed to properly perform its duties under this chapter.
