Requires each governmental body to provide information annually to the governor, the general assembly, the department of administration division on minority and women's business enterprises, and the public concerning the participation of minority and women's business enterprises in contracts and subcontracts of the governmental body for the prior fiscal year.

HOUSE BILL No. 1217



    A BILL FOR AN ACT to amend the Indiana Code concerning state and local administration.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 5-22-3-8; (13)IN1217.1.1. -->     SECTION 1. IC 5-22-3-8 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2013]: Sec. 8. (a) For purposes of this section, "division" means the division on minority and women's business enterprises of the Indiana department of administration.
    (b) Ninety (90) days after the close of a governmental body's fiscal year, each governmental body shall provide to the governor, the general assembly, and the division, and post on the governmental body's Internet web site, a report containing the following information concerning participation by certified minority and women's business enterprises in contracts and subcontracts entered into by the governmental body and concerning the amount spent by the governmental body during the preceding fiscal year under those contracts and subcontracts, including:
        (1) The total number and dollar value of procurement contracts between the governmental body and certified

minority and women's business enterprises, whether the certified minority and women's business enterprise participated as a prime contractor or subcontractor, and the classification of the business enterprise.
        (2) The percentage that the minority and women's business enterprise procurement
contracts represent of the total procurement contracts entered into by the governmental body.
        (3) The total number and names of certified minority and women's business enterprises that participated as prime contractors or subcontractors.
        (4) A brief description of each contract or subcontract reported under this subsection.
        (5) A description of the governmental body's minority and women's business enterprise program, including a description of the effectiveness of the program.
        (6) Other information required by the division.

     (c) The division shall compile data required under subsection (b) for inclusion on the Internet web site maintained by the department.
     (d) The information provided to the general assembly under this section must be in an electronic format under IC 5-14-6.
     (e) This section applies only to governmental bodies that are not state agencies if the governmental body has a minority and women's business enterprise program.
