Synopsis: Requires a child to wear a flotation device. Prohibits a
person from operating a boat unless each child less than 13 years of age
onboard the boat is wearing a personal flotation device. Provides for
certain exceptions. Requires that funds collected as a judgment for the
infraction of violating this requirement be deposited in the fish and
wildlife fund.
Effective: July 1, 2012.

A BILL FOR AN ACT to amend the Indiana Code concerning
natural and cultural resources.
(b) Except as provided in subsection (c), a person may not operate a boat unless each child less than thirteen (13) years of age who is onboard the boat is wearing an appropriate personal flotation device approved by the United States Coast Guard.
(c) Subsection (b) does not apply during a period in which:
(1) the child is below deck;
(2) the child is in an enclosed cabin;
(3) the boat is docked or aground; or
(4) the boat is moored or anchored.
(d) Notwithstanding IC 34-28-5-5(c), the funds collected as a judgment for an infraction under section 15 of this chapter for a violation of this section shall be deposited in the fish and wildlife fund established by IC 14-22-3-2.
