Bill Title: Amends the Illinois Procurement Code. Provides that State agreements for performance contracting shall be included in the definition of "contract". Provides that a performance contract shall not be entered into for a period of time exceeding 20 years. Provides that installment payment performance contracts and performance-based lease purchase agreements that guarantee energy or operational cost savings shall be for a term not to exceed 20 years. Effective immediately.

| 2 | AMENDMENT NO. ______. Amend Senate Bill 3802, AS AMENDED, | ||||||
| 3 | by replacing everything after the enacting clause with the | ||||||
| 4 | following:
| ||||||
| 5 | "Section 5. The Illinois Grant Funds Recovery Act is | ||||||
| 6 | amended by changing Section 4.2 as follows:
| ||||||
| 7 | (30 ILCS 705/4.2) | ||||||
| 8 | Sec. 4.2. Suspension of grant making authority. Any grant | ||||||
| 9 | funds and any grant program administered by a grantor agency | ||||||
| 10 | subject to this Act are indefinitely suspended on January 1, | ||||||
| 11 | 2013 July 1, 2012, and on July 1st of every 5th year | ||||||
| 12 | thereafter, unless the General Assembly, by law, authorizes | ||||||
| 13 | that grantor agency to make grants or lifts the suspension of | ||||||
| 14 | the authorization of that grantor agency to make grants. In the | ||||||
| 15 | case of a suspension of the authorization of a grantor agency | ||||||
| 16 | to make grants, the authority of that grantor agency to make | ||||||

| |||||||
| 1 | grants is suspended until the suspension is explicitly lifted | ||||||
| 2 | by law by the General Assembly, even if an appropriation has | ||||||
| 3 | been made for the explicit purpose of such grants. This | ||||||
| 4 | suspension of grant making authority supersedes any other law | ||||||
| 5 | or rule to the contrary.

| 7 | Section 99. Effective date. This Act takes effect July 1, | ||||||
