Bill Title: Amends the Counties Code, Township Code, and the Illinois Municipal Code. Provides that a county, township, or municipality, as applicable, may not charge fees for emergency or rescue services rendered by the fire department against persons, businesses, and other entities who are not residents of the county, township, or municipality, respectively. Effective immediately.

1 | AN ACT concerning local government.

2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:

4 | Section 5. The Counties Code is amended by adding Section | |||||||||||||||||||||||
5 | 5-1134 as follows:

6 | (55 ILCS 5/5-1134 new) | |||||||||||||||||||||||
7 | Sec. 5-1134. Fee for emergency fire and rescue services. | |||||||||||||||||||||||
8 | The county board may not charge fees for emergency or rescue | |||||||||||||||||||||||
9 | services rendered by the fire department of the county against | |||||||||||||||||||||||
10 | persons, businesses, and other entities who are not residents | |||||||||||||||||||||||
11 | of the county.

12 | Section 10. The Township Code is amended by changing | |||||||||||||||||||||||
13 | Sections 200-14a and 200-14b as follows:

14 | (60 ILCS 1/200-14b) | |||||||||||||||||||||||
15 | Sec. 200-14b. Technical rescue services. A township that | |||||||||||||||||||||||
16 | provides fire protection services may fix, charge, and collect | |||||||||||||||||||||||
17 | reasonable fees for technical rescue services provided by the | |||||||||||||||||||||||
18 | township. The total amount collected may not exceed the | |||||||||||||||||||||||
19 | reasonable cost of providing the technical rescue services and | |||||||||||||||||||||||
20 | may include charges for personnel and equipment costs. A | |||||||||||||||||||||||
21 | township may not charge fees for emergency or rescue services |

5 | Section 15. The Illinois Municipal Code is amended by | ||||||
6 | adding Section 11-6-1.2 as follows:

8 | Sec. 11-6-1.2. Fee for emergency fire and rescue services. | ||||||
9 | The corporate authorities of a municipality may not charge fees | ||||||
10 | for emergency or rescue services rendered by the fire | ||||||
11 | department of the municipality against persons, businesses, | ||||||
12 | and other entities who are not residents of the municipality.

13 | Section 99. Effective date. This Act takes effect upon | ||||||
14 | becoming law.
