Bill Title: Amends the State Finance Act. Creates the Sons of American Legion Scholarship Fund as a special fund in the State treasury. Amends the Illinois Vehicle Code. Provides for the issuance of Sons of the American Legion special license plates. Provides that an applicant shall be charged an additional fee of $15 at original issuance and an additional $10 upon renewal. Provides that $5 of the original issuance fee and renewal fee shall be deposited into the Secretary of State Special License Plate Fund. Provides that $10 of the original issuance fee and $5 of the renewal fee shall be deposited into the Sons of American Legion Scholarship Fund. Provides all moneys in the Sons of the American Legion Scholarship Fund shall, subject to appropriation, be used for grants for scholarships for Illinois residents who are children of members of the Sons of the American Legion and who meet the academic, financial, and other requirements established by the Sons of the American Legion. Provides that all grants must be used at a college or university in Illinois.

4 | Section 5. The State Finance Act is amended by adding | ||||||||||||||||||||||||||
5 | Section 5.866 as follows:

12 | Sec. 3-699.14. Sons of the American Legion license plates. | ||||||||||||||||||||||||||
13 | (a) The Secretary, upon receipt of all applicable fees and | ||||||||||||||||||||||||||
14 | applications made in the form prescribed by the Secretary of | ||||||||||||||||||||||||||
15 | State, may issue special registration plates designated as Sons | ||||||||||||||||||||||||||
16 | of the American Legion license plates. The special plates | ||||||||||||||||||||||||||
17 | issued under this Section shall be affixed only to passenger | ||||||||||||||||||||||||||
18 | vehicles of the first division or motor vehicles of the second | ||||||||||||||||||||||||||
19 | division weighing not more than 8,000 lbs. Plates issued under | ||||||||||||||||||||||||||
20 | this Section shall expire according to the multi-year procedure | ||||||||||||||||||||||||||
21 | established by Section 3-414.1 of this Code.

1 | (b) The design and color of the special plates shall be | ||||||
2 | wholly within the discretion of the Secretary, except that
the | ||||||
3 | phrase "Sons of the American Legion", and the official Emblem | ||||||
4 | of the Sons of the American
Legion shall be on the plates. The | ||||||
5 | Secretary may allow the plates to be issued as vanity plates or
| ||||||
6 | personalized plates under Section 3-405.1 of the Code. | ||||||
7 | Appropriate documentation, as determined by the Secretary, | ||||||
8 | shall accompany each application. | ||||||
9 | (c) A series of letters and numbers shall be reserved for | ||||||
10 | special plates issued under this Section to past detachment | ||||||
11 | commanders of the Sons of the American Legion. The series of | ||||||
12 | letters and numbers reserved under this Section shall have the | ||||||
13 | prefix of "PDC" and be followed
by 2 numerals ranging from | ||||||
14 | 00-99 that designate the year that the past detachment | ||||||
15 | commander last served. For example, "PDC 08"
would identify the | ||||||
16 | past detachment commander that last served during the year | ||||||
17 | 2008. Certification by the detachment
adjutant will be required | ||||||
18 | in the form of a letter verifying service dates of the past | ||||||
19 | detachment commander for issuance of the special plate. | ||||||
20 | (d) An applicant for the special plate shall be charged a | ||||||
21 | $15 fee for original issuance in addition
to the appropriate | ||||||
22 | registration fee. Of this additional fee, $10 shall be | ||||||
23 | deposited into the Sons of the American Legion Scholarship Fund | ||||||
24 | and $5 shall be deposited into the Secretary
of State Special | ||||||
25 | License Plate Fund, to be used by the Secretary to help defray | ||||||
26 | the administrative
processing costs. For each registration |

1 | renewal period, a $10 fee, in addition to the appropriate | ||||||
2 | registration fee, shall be
charged. Of this additional fee, $5 | ||||||
3 | shall be deposited into the Sons of the American Legion | ||||||
4 | Scholarship Fund and $5 shall be deposited into the Secretary | ||||||
5 | of State Special
License Plate Fund. | ||||||
6 | (e) The Sons of the American Legion Scholarship Fund is | ||||||
7 | created as a special fund in the State treasury. All moneys in | ||||||
8 | the Sons of the American Legion Scholarship Fund shall be paid, | ||||||
9 | subject to appropriation by the General Assembly and | ||||||
10 | distribution by the Secretary, as grants for scholarships for | ||||||
11 | higher education. The scholarship recipients must be the | ||||||
12 | children of current or former members of the Sons of the | ||||||
13 | American Legion who meet the academic, financial, and other | ||||||
14 | requirements established by the Sons of the American Legion. In | ||||||
15 | addition, the recipients must be residents of this State and | ||||||
16 | must attend a college or university located within this State.
