Bill Title: Amends the Nurse Practice Act. Ratifies and adopts the Nurse Licensure Compact. Allows for reciprocity of licensure of licensed practical nurses and registered nurses among the states. Provides for administration of the Compact by the Nursing Act Coordinator. Provides that the licensing board shall participate in a Compact Evaluation Initiative designed to evaluate the effectiveness and operability of the Compact. Provides that the Compact does not relieve employers from complying with statutorily imposed obligations. Provides that the Compact does not supersede existing State labor laws. Makes changes relating to the purposes of the Compact. Provides that any practical nurse or registered nurse exercising the practice privilege afforded under the Nurse Licensure Compact who provides direct patient care in Illinois shall be registered with the eNotify Nurses Database system which can be assessed at no cost by the Department of Financial and Professional Regulation. Provides that the Department may revoke or limit the multistate licensure privilege of any practical nurse or registered nurse to practice in Illinois necessary to protect the health and safety of the public. Further provides that a practical nurse or registered nurse shall be denied the privilege to practice by the Department if he or she has been convicted of certain criminal offenses or has been required to register under the Sex Offender Registration Act. Provides that each practical nurse or registered nurse licensed by a party state under the Nurse Licensure Compact that is applying for the privilege to practice in this State shall have his or her fingerprints submitted to the Department of State Police for the purposes of a criminal history records check.

2 | AMENDMENT NO. ______. Amend Senate Bill 3513 as follows:

3 | by replacing line 9 on page 36 through line 2 on page 38 with | ||||||
4 | the following: | ||||||
5 | " (n) A practical nurse licensed by a party state under the | ||||||
6 | Nurse Licensure Compact under Article 80 of this Act is granted | ||||||
7 | the privilege to practice practical nursing in this State. The | ||||||
8 | employer of a practical nurse exercising the practice privilege | ||||||
9 | afforded under this subsection (n) who provides direct patient | ||||||
10 | care in Illinois shall file a report with the Department as | ||||||
11 | determined by rule. The report shall be in a form and manner | ||||||
12 | designated by the Department and shall include without | ||||||
13 | limitation the name, address, social security number, and | ||||||
14 | current licensure information of the nurse and any other | ||||||
15 | information deemed necessary by the Department, as defined by | ||||||
16 | rule. The Department may revoke or limit the multistate | ||||||
17 | licensure privilege of any practical nurse to practice in |

2 | public.

3 | (o) A practical nurse licensed by a party state under the | ||||||
4 | Nurse Licensure Compact under Article 80 of this Act shall be | ||||||
5 | denied the privilege to practice by the Department if he or | ||||||
6 | she: (1) has been convicted of a criminal act that requires | ||||||
7 | registration under the Sex Offender Registration Act; (2) has | ||||||
8 | been convicted of a criminal battery against any patient in the | ||||||
9 | course of patient care or treatment, including any offense | ||||||
10 | based on sexual conduct or sexual penetration; (3) has been | ||||||
11 | convicted of a forcible felony; (4) is required as a part of a | ||||||
12 | criminal sentence to register under the Sex Offender | ||||||
13 | Registration Act; or (5) is convicted of any other crime or | ||||||
14 | engages in any conduct that would be grounds for discipline | ||||||
15 | under subsection (a) of Section 2105-165 of the Department of | ||||||
16 | Professional Regulation Law of the Civil Administrative Code of | ||||||
17 | Illinois. | ||||||
18 | (p) Each practical nurse licensed by a party state under | ||||||
19 | the Nurse Licensure Compact under Article 80 of this Act who | ||||||
20 | intends to provide direct patient care in this State shall be | ||||||
21 | subject to the requirements of Section 50-35 of this Act and | ||||||
22 | shall have his or her fingerprints submitted to the Department | ||||||
23 | of State Police in accordance with the requirements of Section | ||||||
24 | 50-35. Fingerprints shall be submitted within 60 days prior to | ||||||
25 | practice in this State. "; and
