Bill Title: Amends the Transportation Cooperation Act of 1971, the Department of Transportation Law of the Civil Administrative Code of Illinois, the Bi-State Development Agency Act, and the Regional Transportation Authority Act. Provides that a railroad passenger service, a Transportation Service Association, the Department of Transportation, the Regional Transportation Authority, the Chicago Transit Authority, and the Commuter Rail Division of the Regional Transportation Authority shall issue an annual report on or before December 31 of each year containing all rail safety recommendations made by the National Transportation Safety Board during the previous 12 months and the status of the entity's implementation of those recommendations. Provides that the Federal Railroad Corporation (also known as Amtrak) and the Bi-State Development Agency may issue a similar report. Provides that a report issued under the provisions shall be made publicly available on the website of the entity. Effective July 1, 2024.

AN ACT concerning commuter passenger rail service.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Transportation Cooperation Act of 1971 is
amended by adding Section 7.5 as follows:
(5 ILCS 225/7.5 new)
Sec. 7.5. Rail safety recommendation report.
(a) A railroad passenger service or Association shall
issue an annual report on or before December 31 of each year
containing all rail safety recommendations made by the
National Transportation Safety Board during the previous 12
months and the status of the service's or Association's
implementation of those recommendations. The report shall be
made publicly available on the website of the rail passenger
service or Association.
(b) The Federal Railroad Corporation may issue an annual
report on or before December 31 of each year containing all
rail safety recommendations made by the National
Transportation Safety Board during the previous 12 months and
the status of the Corporation's implementation of those
recommendations. If the Corporation voluntarily issues a
report under this subsection, the Corporation shall make the
report publicly available on the Corporation's website.
Section 10. The Department of Transportation Law of the
Civil Administrative Code of Illinois is amended by adding
Section 2705-423 as follows:

Sec. 2705-423. Rail safety recommendation report. The
Department shall issue an annual report on or before December
31 of each year containing all rail safety recommendations
made by the National Transportation Safety Board during the
previous 12 months and the status of the Department's
implementation of those recommendations. The report shall be
made publicly available on the Department's website.
Section 15. The Bi-State Development Agency Act is amended
by adding Section 8.5 as follows:

Sec. 8.5. Rail safety recommendation report. The Bi-State
Development Agency may issue an annual report on or before
December 31 of each year containing all rail safety
recommendations made by the National Transportation Safety
Board during the previous 12 months and the status of the
Corporation's implementation of those recommendations. If the
Bi-State Development Agency voluntarily issues a report under
this Section, the Bi-State Development Agency shall make the
report publicly available on the Agency's website.
Section 20. The Regional Transportation Authority Act is
amended by adding Section 5.15 as follows:

Sec. 5.15. Rail safety recommendation report. The Regional
Transportation Authority, the Chicago Transit Authority, and
the Commuter Rail Division shall issue an annual report on or
before December 31 of each year containing all rail safety
recommendations made by the National Transportation Safety
Board during the previous 12 months and the status of the
Regional Transportation Authority's, the Chicago Transit
Authority's, and the Commuter Rail Division's implementation
of those recommendations, including for any recommendations
within the Regional Transportation Authority's
extra-territorial authority, if any. The reports shall be made
publicly available on the Regional Transportation Authority's
website.
