Bill Title: Amends the Higher Education Student Assistance Act. Provides that a student who is already licensed to teach and is enrolled in a course of study leading to an additional teaching endorsement or a master's degree in an academic field in which he or she is teaching or plans to teach may participate in the Minority Teachers of Illinois scholarship program (rather than limiting the program to undergraduate students). Makes a conforming change. Effective immediately.

1 | AN ACT concerning education.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Election Code is amended by changing Section | ||||||
5 | 12-5 as follows:
| ||||||
6 | (10 ILCS 5/12-5) (from Ch. 46, par. 12-5)
| ||||||
7 | Sec. 12-5. Notice for public questions. | ||||||
8 | (a) Except as otherwise provided in subsection (b), for For | ||||||
9 | all elections held after July
1, 1999, notice of public
| ||||||
10 | questions shall be required only as set forth in this
Section | ||||||
11 | or as set forth in Section 17-3 or 19-3 of the School Code. Not
| ||||||
12 | more than
30 days nor less than 10 days before the date of a
| ||||||
13 | regular election at which a public question is to be submitted | ||||||
14 | to the voters of
a political or governmental subdivision, and | ||||||
15 | at least 20 days before an
emergency referendum, the election | ||||||
16 | authority shall publish notice of the
referendum. The notice | ||||||
17 | shall be published once in a local, community newspaper
having | ||||||
18 | general circulation in the political or governmental | ||||||
19 | subdivision. The
notice shall also be given at least 10 days | ||||||
20 | before the date of the election by
posting a copy of the notice | ||||||
21 | at the principal office of the election
authority. The local | ||||||
22 | election official shall also post a copy of the notice at
the | ||||||
23 | principal office of the political or governmental
subdivision, |

1 | or if there is no principal office at the building in which the
| ||||||
2 | governing body of the political or governmental subdivision | ||||||
3 | held its first
meeting of the calendar year in which the | ||||||
4 | referendum is being held. The
election authority and the | ||||||
5 | political or governmental subdivision may, but are
not required | ||||||
6 | to, post the notice electronically on their World Wide Web | ||||||
7 | pages.
The notice, which shall appear over the name or title of | ||||||
8 | the election
authority, shall be substantially in the following | ||||||
9 | form:

10 | NOTICE IS HEREBY GIVEN that at the election to be held | ||||||
11 | on
(insert day of the week),
(insert date of election), the | ||||||
12 | following proposition will be
submitted to the voters of | ||||||
13 | (name of political or governmental subdivision):
| ||||||
14 | (insert the public question as it will appear on the | ||||||
15 | ballot)
| ||||||
16 | The polls at the election will be open at 6:00 o'clock | ||||||
17 | A.M. and will
continue to be open until 7:00 o'clock P.M. | ||||||
18 | of that day.

19 | Dated (date of notice)
| ||||||
20 | (Name or title of the election authority)
| ||||||
21 | The notice shall also include any additional information | ||||||
22 | required by the statute authorizing the public question. The | ||||||
23 | notice may include an explanation, in neutral and plain | ||||||
24 | language, of the question and its purposes supplied by the | ||||||
25 | governing body of the political or governmental subdivision to | ||||||
26 | whose voters the question is to be submitted. The notice shall |

precincts and polling places at which the | ||||||
2 | referendum will be conducted only in
the case of emergency | ||||||
3 | referenda. | ||||||
4 | (b) Notice of any public question published in a local, | ||||||
5 | community newspaper having general circulation in the | ||||||
6 | political or governmental subdivision to which such public | ||||||
7 | question relates more than 30 days but not more than 35 days | ||||||
8 | prior to the general election held on November 8, 2016 that | ||||||
9 | otherwise complies with the requirements of this Section is | ||||||
10 | sufficient notice to satisfy the newspaper publication | ||||||
11 | requirement of this Section, such notice shall for all purposes | ||||||
12 | be deemed to have been given in accordance with this Section, | ||||||
13 | any bonds approved by the voters at such election are hereby | ||||||
14 | authorized to be issued in accordance with applicable law | ||||||
15 | without further referendum approval and taxes to be levied | ||||||
16 | pursuant to any limiting rate increases approved by the voters | ||||||
17 | at such election are hereby authorized to be levied and | ||||||
18 | extended without further referendum approval.

20 | Section 99. Effective date. This Act takes effect upon | ||||||
21 | becoming law.
