Bill Title: Amends the Illinois Municipal Code. Provides that the corporate authorities of each municipality may use a public utility's utility pole within the municipality's public rights-of-way for municipal public safety purposes, including, but not limited to, the placing of equipment associated with public safety. Provides that any fee charged by a public utility for the use of a utility pole by the municipality under the provisions shall be at the lowest rate charged by the public utility owing the utility pole and shall not exceed the public utility's actual costs. Amends the Public Utilities Act to make a conforming change.

AN ACT concerning local government.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Illinois Municipal Code is amended by
adding Section 11-80-25 as follows:
(65 ILCS 5/11-80-25 new)
Sec. 11-80-25. Municipal use of utility pole for municipal
public safety.
(a) As used in this Section, "public utility" has the
meaning given to that term in Section 3-105 of the Public
Utilities Act.
(b) The corporate authorities of a municipality may use a
public utility's utility pole within the municipality's public
rights-of-way for municipal public safety purposes, including,
but not limited to, the placing of equipment associated with
public safety.
(c) Any fee charged by a public utility for the use of a
utility pole by a municipality under this Section shall be at
the lowest rate charged by the public utility owning the
utility pole and shall not exceed the public utility's actual
costs.
