Bill Title: Amends the Local Governmental and Governmental Employees Tort Immunity Act. Provides that a local public entity is not liable for the bodily injury or death of a driver or passenger in a stolen vehicle if the plaintiff was, during the course of the alleged negligence, in flight or fleeing apprehension during the commission of the offense of fleeing or attempting to elude a peace officer or aggravated fleeing or attempting to elude a peace officer. Effective immediately.

2 | Be it enacted by the People of the State of Illinois,

4 | Section 5. The Local Governmental and Governmental | |||||||||||||||||||

Immunity Act is amended by adding Section | |||||||||||||||||||
6 | 2-109.5 as follows:

7 | (745 ILCS 10/2-109.5 new) | |||||||||||||||||||
8 | Sec. 2-109.5. Injury or death caused by fleeing or | |||||||||||||||||||
9 | attempting to elude peace officer in stolen vehicle. A local | |||||||||||||||||||
10 | public entity is not liable for the bodily injury or death of a | |||||||||||||||||||
11 | driver or passenger in a stolen vehicle if the plaintiff was, | |||||||||||||||||||
12 | during the course of the alleged negligence, in flight or | |||||||||||||||||||
13 | fleeing apprehension during the commission of the offense of | |||||||||||||||||||
14 | fleeing or attempting to elude a peace officer or aggravated | |||||||||||||||||||
15 | fleeing or attempting to elude a peace officer.
