Bill Title: Amends the Local Governmental and Governmental Employees Tort Immunity Act. Provides that a local public entity is not liable for the bodily injury or death of a driver or passenger in a stolen vehicle if the plaintiff was, during the course of the alleged negligence, in flight or fleeing apprehension during the commission of the offense of fleeing or attempting to elude a peace officer or aggravated fleeing or attempting to elude a peace officer. Effective immediately.

SYNOPSIS AS INTRODUCED:
745 ILCS 10/2-109.5 new

Amends the Local Governmental and Governmental Employees Tort Immunity Act. Provides that a local public entity is not liable for the bodily injury or death of a driver or passenger in a stolen vehicle if the plaintiff was, during the course of the alleged negligence, in flight or fleeing apprehension during the commission of the offense of fleeing or attempting to elude a peace officer or aggravated fleeing or attempting to elude a peace officer. 1 AN ACT concerning civil law.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Local Governmental and Governmental
5Employees Tort Immunity Act is amended by adding Section
62-109.5 as follows:
7 (745 ILCS 10/2-109.5 new)
8 Sec. 2-109.5. Injury or death caused by fleeing or
9attempting to elude peace officer in stolen vehicle. A local
10public entity is not liable for the bodily injury or death of a
11driver or passenger in a stolen vehicle if the plaintiff was,
12during the course of the alleged negligence, in flight or
13fleeing apprehension during the commission of the offense of
14fleeing or attempting to elude a peace officer or aggravated
15fleeing or attempting to elude a peace officer.
16 Section 99. Effective date. This Act takes effect upon
17becoming law.
