SYNOPSIS AS INTRODUCED:
55 ILCS 5/4-7001 from Ch. 34, par. 4-7001

Amends the Counties Code. Provides that fees for a coroner's or medical examiner's permit to cremate a human body is $100 (rather than $50). Provides that fees for a certified copy of a transcript of sworn testimony of a coroner's inquest made by written request declaring the request is for research or genealogy purposes is $15.00 for the entire transcript. Provides that a request shall be deemed a proper request for purpose of research or genealogy if the requested inquest occurred not less than 20 years prior to the date of the written request and that the transcript shall be stamped with the words "FOR GENEALOGY OR RESEARCH PURPOSES ONLY". Provides that a coroner may waive, at his or her discretion, fees under the Section (currently, only the cremation permit fee) if the coroner determines that the person is indigent and unable to pay the permit fee or under other special circumstances as determined by the coroner.

1 AN ACT concerning local government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Counties Code is amended by changing
5Section 4-7001 as follows:
6 (55 ILCS 5/4-7001) (from Ch. 34, par. 4-7001)
7 Sec. 4-7001. Coroner's fees. The fees of the coroner's
8office shall be as follows:
9 1. For a copy of a transcript of sworn testimony:
10 $5.00 per page.
11 2. For a copy of an autopsy report (if not included in
12 transcript): $50.00.
13 3. For a copy of the verdict of a coroner's jury:
14 $5.00.
15 4. For a copy of a toxicology report: $25.00.
16 5. For a print of or an electronic file containing a
17 picture obtained by the coroner: actual cost or $3.00,
18 whichever is greater.
19 6. For each copy of miscellaneous reports, including
20 artist's drawings but not including police reports: actual
21 cost or $25.00, whichever is greater.
22 7. For a coroner's or medical examiner's permit to
23 cremate a dead human body: $100.00 $50.00. The coroner may

1 waive, at his or her discretion, the permit fee if the
2 coroner determines that the person is indigent and unable
3 to pay the permit fee or under other special
4 circumstances.
5 8. For a certified copy of a transcript of sworn
6 testimony of a coroner's inquest made by written request
7 declaring the request is for research or genealogy
8 purposes: $15.00 for the entire transcript. A request
9 shall be deemed a proper request for purpose of research
10 or genealogy if the requested inquest occurred not less
11 than 20 years prior to the date of the written request. The
12 transcript shall be stamped with the words "FOR GENEALOGY
13 OR RESEARCH PURPOSES ONLY".
14 The coroner may waive, at his or her discretion, fees
15under this Section if the coroner determines that the person
16is indigent and unable to pay the permit fee or under other
17special circumstances as determined by the coroner.
18 All of which fees shall be certified by the court; in the
19case of inmates of any State charitable or penal institution,
20the fees shall be paid by the operating department or
21commission, out of the State Treasury. The coroner shall file
22his or her claim in probate for his or her fees and he or she
23shall render assistance to the State's Attorney attorney in
24the collection of such fees out of the estate of the deceased.
25In counties of less than 1,000,000 population, the State's
26Attorney attorney shall collect such fees out of the estate of

1the deceased.
2 Except as otherwise provided in this Section, whenever the
3coroner is required by law to perform any of the duties of the
4office of the sheriff, the coroner is entitled to the like fees
5and compensation as are allowed by law to the sheriff for the
6performance of similar services.
7 Except as otherwise provided in this Section, whenever the
8coroner of any county is required to travel in the performance
9of his or her duties, he or she shall receive the same mileage
10fees as are authorized for the sheriff of such county.
11 All fees under this Section collected by or on behalf of
12the coroner's office shall be paid over to the county
13treasurer and deposited into a special account in the county
14treasury. Moneys in the special account shall be used solely
15for the purchase of electronic and forensic identification
16equipment or other related supplies and the operating expenses
17of the coroner's office.
