AMENDMENT TO SENATE BILL 2809
2 AMENDMENT NO. ______. Amend Senate Bill 2809 by replacing
3everything after the enacting clause with the following:
4 "Section 5. The Illinois Pension Code is amended by
5changing Section 9-179.2 as follows:
6 (40 ILCS 5/9-179.2) (from Ch. 108 1/2, par. 9-179.2)
7 Sec. 9-179.2. Other governmental service - Former County
8Service. Any employee who (i) first became a contributor before
9the effective date of this amendatory Act of the 98th General
10Assembly, (ii) has rendered service to any "governmental unit"
11as such term is defined in the "Retirement Systems Reciprocal
12Act" under Article 20 of the Illinois Pension Code, (iii) who
13did not contribute to the retirement system of such
14"governmental unit", including the retirement system created
15by this Article 9 of the Illinois Pension code, for such
16service because of ineligibility for participation, and (iv)

1has no equity or rights in such retirement system because of
2such service shall be given credit for such service in this
3fund, provided that:
4 (a) the The employee shall pay to this fund, while in
5 the service of such county, or while in the service of a
6 governmental unit whose retirement system has adopted the
7 "Retirement Systems Reciprocal Act", such amounts,
8 including interest at the effective rate, as he would have
9 paid to this fund, on the basis of his salary in effect
10 during the service rendered to such other "governmental
11 unit" at the rates prescribed in this Article 9 for the
12 periods of such service, to the end that such service shall
13 be considered as service rendered to such county, with all
14 the rights and conditions attaching to such service and
15 payments; and
16 (b) this Section shall not be applicable to any period
17 of such service for which the employee retains credit in
18 any other public annuity and benefit fund established by
19 Act of the Legislature of this State and in operation for
20 employees of such other "governmental unit" from which such
21 employee was transferred.

23 Section 99. Effective date. This Act takes effect upon
