Bill Title: Amends the Communicable Disease Prevention Act. Provides that the Department must provide all students (currently, all female students) who are entering sixth grade and their parents or legal guardians written information about the link between human papillomavirus and specified kinds of cancer, and the Centers for Disease Control and Prevention's recommendation for children to be vaccinated with the HPV vaccine (currently, written information about the link between human papillomavirus and cervical cancer and the availability of a HPV vaccine). Provides that the Department shall adopt emergency rules to the extent necessary to administer the Department's responsibilities under the amendatory Act no later than July 1, 2018. Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Provides that beginning on January 1, 2019, the definition for "eligible individual" for provisions concerning human papillomavirus vaccinations includes male children under the age of 18 that meet specified conditions.

2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:

4 | Section 5. The Department of Public Health Powers and | ||||||||||||||||||||||||||
5 | Duties Law of the
Civil Administrative Code of Illinois is | ||||||||||||||||||||||||||
6 | amended by changing Section 2310-617 as follows:

7 | (20 ILCS 2310/2310-617)

8 | Sec. 2310-617. Human papillomavirus vaccine. | ||||||||||||||||||||||||||
9 | (a) As used in this Section, "eligible individual" means a | ||||||||||||||||||||||||||
10 | female child under the age of 18 , and, beginning on January 1, | ||||||||||||||||||||||||||
11 | 2019, a male child under the age of 18 , who is a resident of | ||||||||||||||||||||||||||
12 | Illinois who: (1) is not entitled to receive a human | ||||||||||||||||||||||||||
13 | papillomavirus (HPV) vaccination at no cost as a benefit under | ||||||||||||||||||||||||||
14 | a plan of health insurance, a managed care plan, or a plan | ||||||||||||||||||||||||||
15 | provided by a health maintenance organization, a health | ||||||||||||||||||||||||||
16 | services plan corporation, or a similar entity, and (2) meets | ||||||||||||||||||||||||||
17 | the requirements established by the Department of Public Health | ||||||||||||||||||||||||||
18 | by rule. | ||||||||||||||||||||||||||
19 | (b) Subject to appropriation, the Department of Public | ||||||||||||||||||||||||||
20 | Health shall establish and administer a program, commencing no | ||||||||||||||||||||||||||
21 | later than July 1, 2011, under which any eligible individual | ||||||||||||||||||||||||||
22 | shall, upon the eligible individual's request, receive a series | ||||||||||||||||||||||||||
23 | of HPV vaccinations as medically indicated, at no cost to the |

2 | (c) The Department of Public Health shall adopt rules for | ||||||
3 | the administration and operation of the program, including, but | ||||||
4 | not limited to: determination of the HPV vaccine formulation to | ||||||
5 | be administered and the method of administration; eligibility | ||||||
6 | requirements and eligibility determinations; and standards and | ||||||
7 | criteria for acquisition and distribution of the HPV vaccine | ||||||
8 | and related supplies. The Department may enter into contracts | ||||||
9 | or agreements with public or private entities for the | ||||||
10 | performance of such duties under the program as the Department | ||||||
11 | may deem appropriate to carry out this Section and its rules | ||||||
12 | adopted under this Section.

14 | Section 10. The Communicable Disease Prevention Act is | ||||||
15 | amended by changing Section 2e as follows:

17 | Sec. 2e. Cervical cancer prevention. | ||||||
18 | (a) Notwithstanding the provisions of Section 2 of this | ||||||
19 | Act, beginning August 1, 2007, the Department of Public Health | ||||||
20 | must provide all female students who are entering sixth grade | ||||||
21 | and their parents or legal guardians written information about | ||||||
22 | the link between human papillomavirus (HPV) and cervical, | ||||||
23 | vulvar, and vaginal cancer in females; penile cancer in males; | ||||||
24 | and anal cancer and oropharyngeal cancer in both females and |

1 | males, and the Centers for Disease Control and Prevention's | ||||||
2 | recommendation for children to be vaccinated with the HPV | ||||||
3 | vaccine so that they are protected before ever being exposed to | ||||||
4 | the virus cervical cancer and the availability of a HPV | ||||||
5 | vaccine . | ||||||
6 | (b) The Director of Public Health shall prescribe the | ||||||
7 | content of the information required in subsection (a) of this | ||||||
8 | Section.

9 | (c) In order to provide for the expeditious and timely | ||||||
10 | implementation of the provisions of this amendatory Act of the | ||||||
11 | 95th General Assembly, the Department of Public Health shall | ||||||
12 | adopt emergency rules in accordance with Section 5-45 of the | ||||||
13 | Illinois Administrative Procedure Act to the extent necessary | ||||||
14 | to administer the Department's responsibilities under this | ||||||
15 | amendatory Act of the 95th General Assembly. The adoption of | ||||||
16 | emergency rules authorized by this subsection (c) is deemed to | ||||||
17 | be necessary for the public interest, safety, and welfare.

18 | (d) In order to provide for the expeditious and timely | ||||||
19 | implementation of the provisions of this amendatory Act of the | ||||||
20 | 100th General Assembly, the Department of Public Health shall | ||||||
21 | adopt emergency rules in accordance with Section 5-45 of the | ||||||
22 | Illinois Administrative Procedure Act to the extent necessary | ||||||
23 | to administer the Department's responsibilities under this | ||||||
24 | amendatory Act of the 100th General Assembly no later than July | ||||||
25 | 1, 2018. The adoption of emergency rules authorized by this | ||||||
26 | subsection (d) is deemed to be necessary for the public |
