Bill Title: Amends the Election Code. Provides that a student entitled to vote in a primary, general, special election, or any election at which propositions are submitted to a popular vote in this State is entitled to be absent from school for 2 hours to vote on a day in which early voting is offered or on the day of the election. Provides that the school may specify the hours in which the student may be absent. Provides that a student who is absent from school to vote is not considered absent for the purposes of calculating enrollment under evidence-based funding in the School Code.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Election Code is amended by changing | |||||||||||||||||||||
5 | Sections 7-42 and 17-15 as follows:

7 | Sec. 7-42.
Any person entitled to vote at such primary | |||||||||||||||||||||
8 | shall, on the day of
such primary, with the consent of his | |||||||||||||||||||||
9 | employer or school be entitled to absent
himself from any | |||||||||||||||||||||
10 | service or employment in which he is then engaged or
employed | |||||||||||||||||||||
11 | for a period of two hours between the time of opening and | |||||||||||||||||||||
12 | closing
the polls. The employer or school may specify the hours | |||||||||||||||||||||
13 | during which said employe or student may
absent himself.

22 | polls; and such voter shall not because of so absenting himself |

liable to any penalty; Provided, however, that application | ||||||
2 | for such leave
of absence shall be made prior to the day of | ||||||
3 | election. The employer or school may
specify the hours during | ||||||
4 | which said employee or student may absent himself as
aforesaid, | ||||||
5 | except that the employer or school must permit a 2-hour absence | ||||||
6 | during working or school hours if the employee's working hours | ||||||
7 | or the school's hours begin less than 2 hours after the opening | ||||||
8 | of the polls and end less than 2 hours before the closing of | ||||||
9 | the polls. No person , or corporation , or school shall refuse to | ||||||
10 | an employee or student the
privilege hereby conferred, nor | ||||||
11 | shall subject an employee or student to a penalty, including a | ||||||
12 | reduction in compensation due to an absence under this Section,
| ||||||
13 | because of the exercise of such privilege, nor shall directly | ||||||
14 | or indirectly
violate the provisions of this Section.
