Bill Title: Amends the Illinois Lottery Law. Provides that the Department of the Lottery shall offer a joint special instant scratch-off game for the benefit of the special causes of: the Carolyn Adams Ticket For The Cure; the Scratch-off for Illinois veterans; the Scratch-out Multiple Sclerosis scratch-off game; the Quality of Life scratch-off game; the Go For The Gold scratch-off game; the Scratch-off for State police memorials; the Scratch-off for homelessness prevention programs; the Scratch-off for school STEAM programs; and the Scratch-off for Alzheimer's care, support, education, and awareness. 1 AN ACT concerning State government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Lottery Law is amended by changing
5Sections 21.5, 21.6, 21.7, 21.8, 21.9, 21.10, 21.11, 21.12,
6and 21.13 and by adding Section 21.4 as follows:
7 (20 ILCS 1605/21.4 new)
8 Sec. 21.4. Joint special instant scratch-off game.
9 (a) The Department shall offer a joint special instant
10scratch-off game for the benefit of the special causes
11identified in Sections 21.5, 21.6, 21.7, 21.8, 21.9, 21.10,
1221.11, 21.12, and 21.13. The operation of the game shall be
13governed by this Section and any rules adopted by the
14Department. The game shall commence on July 1, 2023 or as soon
15thereafter, at the discretion of the Director, as is
16reasonably practical. If any provision of this Section is
17inconsistent with any other provision in the Act, then this
18Section governs.
19 (b) Once the joint special instant scratch-off game is
20used to fund a special cause, the game shall be used to fund
21the special cause for the remainder of the special causes'
22existence per the causes' respective Section of this Act.
23 (c) New specialty instant scratch-off games authorized by

1this Act to fund a special cause shall be funded by the joint
2special instant scratch-off game. New specialty instant
3scratch-off games authorized after June 1, 2023 must have a
4sunset date. The Department shall be limited to supporting no
5more than 10 special causes in total at any given time.
6 (d) Net revenue received from the sale of the joint
7special instant scratch-off game for the purposes of this
8Section shall be divided equally among the special causes the
9game benefits. The Department shall transfer the net revenue
10into the special fund identified for each cause in accordance
11with the cause's respective Section of this Act. For the
12purpose of this subsection, "net revenue" means the total
13amount for which tickets have been sold less the sum of the
14amount paid out in prizes and to retailers, and direct and
15estimated administrative expenses incurred in operation of the
16ticket.

18 Sec. 21.5. Carolyn Adams Ticket For The Cure.
19 (a) The Department shall offer a special instant
20scratch-off game with the title of "Carolyn Adams Ticket For
21The Cure". The game shall commence on January 1, 2006 or as
22soon thereafter, in the discretion of the Director, as is
23reasonably practical, and shall be discontinued on December
2431, 2026. The operation of the game shall be governed by this
25Act and any rules adopted by the Department. The Department

1must consult with the Carolyn Adams Ticket For The Cure Board,
2which is established under Section 2310-347 of the Department
3of Public Health Powers and Duties Law of the Civil
4Administrative Code of Illinois, regarding the design and
5promotion of the game. If any provision of this Section is
6inconsistent with any other provision of this Act, then this
7Section governs.
8 (b) The Carolyn Adams Ticket For The Cure Grant Fund is
9created as a special fund in the State treasury. The net
10revenue from the Carolyn Adams Ticket For The Cure special
11instant scratch-off game shall be deposited into the Fund for
12appropriation by the General Assembly solely to the Department
13of Public Health for the purpose of making grants to public or
14private entities in Illinois for the purpose of funding breast
15cancer research, and supportive services for breast cancer
16survivors and those impacted by breast cancer and breast
17cancer education. In awarding grants, the Department of Public
18Health shall consider criteria that includes, but is not
19limited to, projects and initiatives that address disparities
20in incidence and mortality rates of breast cancer, based on
21data from the Illinois Cancer Registry, and populations facing
22barriers to care. The Department of Public Health shall,
23before grants are awarded, provide copies of all grant
24applications to the Carolyn Adams Ticket For The Cure Board,
25receive and review the Board's recommendations and comments,
26and consult with the Board regarding the grants. For purposes

1of this Section, the term "research" includes, without
2limitation, expenditures to develop and advance the
3understanding, techniques, and modalities effective in the
4detection, prevention, screening, and treatment of breast
5cancer and may include clinical trials. The grant funds may
6not be used for institutional, organizational, or
7community-based overhead costs, indirect costs, or levies.
8 Moneys received for the purposes of this Section,
9including, without limitation, net revenue from the special
10instant scratch-off game and gifts, grants, and awards from
11any public or private entity, must be deposited into the Fund.
12Any interest earned on moneys in the Fund must be deposited
13into the Fund.
14 For purposes of this subsection, "net revenue" means the
15total amount for which tickets have been sold less the sum of
16the amount paid out in prizes and the actual administrative
17expenses of the Department solely related to the Ticket For
18The Cure game.
19 (c) During the time that tickets are sold for the Carolyn
20Adams Ticket For The Cure game, the Department shall not
21unreasonably diminish the efforts devoted to marketing any
22other instant scratch-off lottery game.
23 (d) The Department may adopt any rules necessary to
24implement and administer the provisions of this Section.

2 Sec. 21.6. Scratch-off for Illinois veterans.
3 (a) The Department shall offer a special instant
4scratch-off game for the benefit of Illinois veterans. The
5game shall commence on January 1, 2006 or as soon thereafter,
6at the discretion of the Director, as is reasonably practical.
7The operation of the game shall be governed by this Act and any
8rules adopted by the Department. If any provision of this
9Section is inconsistent with any other provision of this Act,
10then this Section governs.
11 (b) The Illinois Veterans Assistance Fund is created as a
12special fund in the State treasury. The net revenue from the
13Illinois veterans scratch-off game shall be deposited into the
14Fund for appropriation by the General Assembly solely to the
15Department of Veterans' Affairs for making grants, funding
16additional services, or conducting additional research
17projects relating to each of the following:
18 (i) veterans' behavioral health services;
19 (ii) veterans' homelessness;
20 (iii) the health insurance costs of veterans;
21 (iv) veterans' disability benefits, including but not
22 limited to, disability benefits provided by veterans
23 service organizations and veterans assistance commissions
24 or centers;
25 (v) the long-term care of veterans; provided that,
26 beginning with moneys appropriated for fiscal year 2008,

1 no more than 20% of such moneys shall be used for health
2 insurance costs;
3 (vi) veteran employment and employment training; and
4 (vii) veterans' emergency financial assistance,
5 including, but not limited to, past due utilities,
6 housing, and transportation costs.
7 In order to expend moneys from this special fund,
8beginning with moneys appropriated for fiscal year 2008, the
9Director of Veterans' Affairs shall appoint a 3-member funding
10authorization committee. The Director shall designate one of
11the members as chairperson. The committee shall meet on a
12quarterly basis, at a minimum, and shall authorize expenditure
13of moneys from the special fund by a two-thirds vote.
14Decisions of the committee shall not take effect unless and
15until approved by the Director of Veterans' Affairs. Each
16member of the committee shall serve until a replacement is
17named by the Director of Veterans' Affairs. One member of the
18committee shall be a member of the Veterans' Advisory Council.
19 Moneys collected from the special instant scratch-off game
20shall be used only as a supplemental financial resource and
21shall not supplant existing moneys that the Department of
22Veterans' Affairs may currently expend for the purposes set
23forth in items (i) through (v).
24 Moneys received for the purposes of this Section,
25including, without limitation, net revenue from the special
26instant scratch-off game and from gifts, grants, and awards

1from any public or private entity, must be deposited into the
2Fund. Any interest earned on moneys in the Fund must be
3deposited into the Fund.
4 For purposes of this subsection, "net revenue" means the
5total amount for which tickets have been sold less the sum of
6the amount paid out in the prizes and the actual
7administrative expenses of the Department solely related to
8the scratch-off game under this Section.
9 (c) During the time that tickets are sold for the Illinois
10veterans scratch-off game, the Department shall not
11unreasonably diminish the efforts devoted to marketing any
12other instant scratch-off lottery game.
13 (d) The Department may adopt any rules necessary to
14implement and administer the provisions of this Section.

17 Sec. 21.7. Scratch-out Multiple Sclerosis scratch-off
18game.
19 (a) The Department shall offer a special instant
20scratch-off game for the benefit of research pertaining to
21multiple sclerosis. The game shall commence on July 1, 2008 or
22as soon thereafter, in the discretion of the Director, as is
23reasonably practical. The operation of the game shall be
24governed by this Act and any rules adopted by the Department.
25If any provision of this Section is inconsistent with any

1other provision of this Act, then this Section governs.
2 (b) The Multiple Sclerosis Research Fund is created as a
3special fund in the State treasury. The net revenue from the
4scratch-out multiple sclerosis scratch-off game created under
5this Section shall be deposited into the Fund for
6appropriation by the General Assembly to the Department of
7Public Health for the purpose of making grants to
8organizations in Illinois that conduct research pertaining to
9the repair and prevention of damage caused by an acquired
10demyelinating disease of the central nervous system.
11 Moneys received for the purposes of this Section,
12including, without limitation, net revenue from the special
13instant scratch-off game and from gifts, grants, and awards
14from any public or private entity, must be deposited into the
15Fund. Any interest earned on moneys in the Fund must be
16deposited into the Fund.
17 For purposes of this Section, the term "research"
18includes, without limitation, expenditures to develop and
19advance the understanding, techniques, and modalities
20effective for maintaining function, mobility, and strength
21through preventive physical therapy or other treatments and to
22develop and advance the repair, and also the prevention, of
23myelin, neuron, and axon damage caused by an acquired
24demyelinating disease of the central nervous system and the
25restoration of function, including but not limited to, nervous
26system repair or neuroregeneration.

1 The grant funds may not be used for institutional,
2organizational, or community-based overhead costs, indirect
3costs, or levies.
4 For purposes of this subsection, "net revenue" means the
5total amount for which tickets have been sold less the sum of
6the amount paid out in the prizes and the actual
7administrative expenses of the Department solely related to
8the scratch-off game under this Section.
9 (c) During the time that tickets are sold for the
10scratch-out multiple sclerosis scratch-off game, the
11Department shall not unreasonably diminish the efforts devoted
12to marketing any other instant scratch-off lottery game.
13 (d) The Department may adopt any rules necessary to
14implement and administer the provisions of this Section.

17 Sec. 21.8. Quality of Life scratch-off game.
18 (a) The Department shall offer a special instant
19scratch-off game with the title of "Quality of Life". The game
20shall commence on July 1, 2007 or as soon thereafter, in the
21discretion of the Director, as is reasonably practical, and
22shall be discontinued on December 31, 2025. The operation of
23the game is governed by this Act and by any rules adopted by
24the Department. The Department must consult with the Quality
25of Life Board, which is established under Section 2310-348 of

1the Department of Public Health Powers and Duties Law of the
2Civil Administrative Code of Illinois, regarding the design
3and promotion of the game. If any provision of this Section is
4inconsistent with any other provision of this Act, then this
5Section governs.
6 (b) The Quality of Life Endowment Fund is created as a
7special fund in the State treasury. The net revenue from the
8Quality of Life special instant scratch-off game must be
9deposited into the Fund for appropriation by the General
10Assembly solely to the Department of Public Health for the
11purpose of HIV/AIDS-prevention education and for making grants
12to public or private entities in Illinois for the purpose of
13funding organizations that serve the highest at-risk
14categories for contracting HIV or developing AIDS. Grants
15shall be targeted to serve at-risk populations in proportion
16to the distribution of recent reported Illinois HIV/AIDS cases
17among risk groups as reported by the Illinois Department of
18Public Health. The recipient organizations must be engaged in
19HIV/AIDS-prevention education and HIV/AIDS healthcare
20treatment. The Department must, before grants are awarded,
21provide copies of all grant applications to the Quality of
22Life Board, receive and review the Board's recommendations and
23comments, and consult with the Board regarding the grants.
24Organizational size will determine an organization's
25competitive slot in the "Request for Proposal" process.
26Organizations with an annual budget of $300,000 or less will

1compete with like size organizations for 50% of the Quality of
2Life annual fund. Organizations with an annual budget of
3$300,001 to $700,000 will compete with like organizations for
425% of the Quality of Life annual fund, and organizations with
5an annual budget of $700,001 and upward will compete with like
6organizations for 25% of the Quality of Life annual fund. The
7lottery may designate a percentage of proceeds for marketing
8purposes. The grant funds may not be used for institutional,
9organizational, or community-based overhead costs, indirect
10costs, or levies.
11 Grants awarded from the Fund are intended to augment the
12current and future State funding for the prevention and
13treatment of HIV/AIDS and are not intended to replace that
14funding.
15 Moneys received for the purposes of this Section,
16including, without limitation, net revenue from the special
17instant scratch-off game and gifts, grants, and awards from
18any public or private entity, must be deposited into the Fund.
19Any interest earned on moneys in the Fund must be deposited
20into the Fund.
21 For purposes of this subsection, "net revenue" means the
22total amount for which tickets have been sold less the sum of
23the amount paid out in prizes and the actual administrative
24expenses of the Department solely related to the Quality of
25Life game.
26 (c) During the time that tickets are sold for the Quality

1of Life game, the Department shall not unreasonably diminish
2the efforts devoted to marketing any other instant scratch-off
3lottery game.
4 (d) The Department may adopt any rules necessary to
5implement and administer the provisions of this Section in
6consultation with the Quality of Life Board.

9 Sec. 21.9. Go For The Gold scratch-off game.
10 (a) The Department shall offer a special instant
11scratch-off game with the title of "Go For The Gold". The game
12must commence on July 1, 2014 or as soon thereafter, at the
13discretion of the Director, as is reasonably practical. The
14operation of the game is governed by this Act and by any rules
15adopted by the Department. If any provision of this Section is
16inconsistent with any other provision of this Act, then this
17Section governs.
18 (b) The Special Olympics Illinois and Special Children's
19Charities Fund is created as a special fund in the State
20treasury. The net revenue from the Go For The Gold special
21instant scratch-off game must be deposited into the Special
22Olympics Illinois and Special Children's Charities Fund for
23appropriation by the General Assembly solely to the Department
24of Human Services, which must distribute the moneys as
25follows: (i) 75% of the moneys to Special Olympics Illinois to

1support the statewide training, competitions, and programs for
2future Special Olympics athletes; and (ii) 25% of the moneys
3to Special Children's Charities to support the City of
4Chicago-wide training, competitions, and programs for future
5Special Olympics athletes. The moneys may not be used for
6institutional, organizational, or community-based overhead
7costs, indirect costs, or levies.
8 Moneys received for the purposes of this Section,
9including, without limitation, net revenue from the special
10instant scratch-off game and gifts, grants, and awards from
11any public or private entity, must be deposited into the
12Special Olympics and Special Children's Charities Fund. Any
13interest earned on moneys in the Special Olympics and Special
14Children's Charities Fund must be deposited into the Special
15Olympics and Special Children's Charities Fund.
16 For purposes of this subsection, "net revenue" means the
17total amount for which tickets have been sold less the sum of
18the amount paid out in prizes and the actual administrative
19expenses of the Department solely related to the Go For The
20Gold game.
21 (c) During the time that tickets are sold for the Go For
22The Gold game, the Department shall not unreasonably diminish
23the efforts devoted to marketing any other instant scratch-off
24lottery game.
25 (d) The Department may adopt any rules necessary to
26implement and administer the provisions of this Section.

3 Sec. 21.10. Scratch-off for State police memorials.
4 (a) The Department shall offer a special instant
5scratch-off game for the benefit of State police memorials.
6The game shall commence on January 1, 2019 or as soon
7thereafter, at the discretion of the Director, as is
8reasonably practical. The operation of the game shall be
9governed by this Act and any rules adopted by the Department.
10If any provision of this Section is inconsistent with any
11other provision of this Act, then this Section governs.
12 (b) The net revenue from the State police memorials
13scratch-off game shall be deposited into the Criminal Justice
14Information Projects Fund and distributed equally, as soon as
15practical but at least on a monthly basis, to the Chicago
16Police Memorial Foundation Fund, the Police Memorial Committee
17Fund, and the Illinois State Police Memorial Park Fund. Moneys
18transferred to the funds under this Section shall be used,
19subject to appropriation, to fund grants for building and
20maintaining memorials and parks; holding annual memorial
21commemorations; giving scholarships to children of officers
22killed or catastrophically injured in the line of duty, or
23those interested in pursuing a career in law enforcement;
24providing financial assistance to police officers and their
25families when a police officer is killed or injured in the line

1of duty; and providing financial assistance to officers for
2the purchase or replacement of bulletproof vests to be used in
3the line of duty.
4 For purposes of this subsection, "net revenue" means the
5total amount for which tickets have been sold less the sum of
6the amount paid out in the prizes and the actual
7administrative expenses of the Department solely related to
8the scratch-off game under this Section.
9 (c) During the time that tickets are sold for the State
10police memorials scratch-off game, the Department shall not
11unreasonably diminish the efforts devoted to marketing any
12other instant scratch-off lottery game.
13 (d) The Department may adopt any rules necessary to
14implement and administer the provisions of this Section.

17 Sec. 21.11. Scratch-off for homelessness prevention
18programs.
19 (a) The Department shall offer a special instant
20scratch-off game to fund homelessness prevention programs. The
21game shall commence on July 1, 2019 or as soon thereafter, at
22the discretion of the Director, as is reasonably practical.
23The operation of the game shall be governed by this Act and any
24rules adopted by the Department. If any provision of this
25Section is inconsistent with any other provision of this Act,

1then this Section governs.
2 (b) The Homelessness Prevention Revenue Fund is created as
3a special fund in the State treasury. The net revenue from the
4scratch-off game to fund homelessness prevention programs
5shall be deposited into the Homelessness Prevention Revenue
6Fund. Subject to appropriation, moneys in the Fund shall be
7used by the Department of Human Services solely for grants to
8homelessness prevention and assistance projects under the
9Homelessness Prevention Act.
10 As used in this subsection, "net revenue" means the total
11amount for which tickets have been sold less the sum of the
12amount paid out in the prizes and the actual administrative
13expenses of the Department solely related to the scratch-off
14game under this Section.
15 (c) During the time that tickets are sold for the
16scratch-off game to fund homelessness prevention programs, the
17Department shall not unreasonably diminish the efforts devoted
18to marketing any other instant scratch-off lottery game.
19 (d) The Department may adopt any rules necessary to
20implement and administer the provisions of this Section.
21 (e) Nothing in this Section shall be construed to affect
22any revenue that any Homelessness Prevention line item
23receives through the General Revenue Fund or the Illinois
24Affordable Housing Trust Fund.

2 Sec. 21.12. Scratch-off for school STEAM programs.
3 (a) The Department shall offer a special instant
4scratch-off game for the benefit of school STEAM programming.
5The game shall commence on January 1, 2020 or as soon
6thereafter, at the discretion of the Director, as is
7reasonably practical, and shall be discontinued on January 1,
82021. The operation of the game shall be governed by the Act
9and any rules adopted by the Department. If any provision of
10this Section is inconsistent with any other provision of this
11Act, then this Section governs.
12 (b) The net revenue from the scratch-off for school STEAM
13programs shall be deposited into the School STEAM Grant
14Program Fund as soon as practical, but at least on a monthly
15basis. Moneys deposited into the Fund under this Section shall
16be used, subject to appropriation, by the State Board of
17Education to fund school STEAM grants pursuant to Section
182-3.119a of the School Code.
19 For purposes of this subsection, "net revenue" means the
20total amount for which tickets have been sold less the sum of
21the amount paid out in the prizes and the actual
22administrative expenses of the Department solely related to
23the scratch-off game under this Section.
24 (c) During the time that tickets are sold for the school
25STEAM programs scratch-off game, the Department shall not
26unreasonably diminish the efforts devoted to marketing any

1other instant scratch-off lottery game.
2 (d) The Department may adopt any rules necessary to

6 Sec. 21.13. Scratch-off for Alzheimer's care, support,
7education, and awareness.
8 (a) The Department shall offer a special instant
9scratch-off game for the benefit of Alzheimer's care, support,
10education, and awareness. The game shall commence on January
111, 2020 or as soon thereafter, at the discretion of the
12Director, as is reasonably practical, and shall be
13discontinued on January 1, 2025. The operation of the game
14shall be governed by this Act and any rules adopted by the
15Department. If any provision of this Section is inconsistent
16with any other provision of this Act, then this Section
17governs.
18 (b) The net revenue from the Alzheimer's care, support,
19education, and awareness scratch-off game shall be deposited
20into the Alzheimer's Awareness Fund.
21 Moneys received for the purposes of this Section,
22including, without limitation, net revenue from the special
23instant scratch-off game and from gifts, grants, and awards
24from any public or private entity, must be deposited into the
25Fund. Any interest earned on moneys in the Fund must be

1deposited into the Fund.
2 For the purposes of this subsection, "net revenue" means
3the total amount for which tickets have been sold less the sum
4of the amount paid out in the prizes and the actual
5administrative expenses of the Department solely related to
6the scratch-off game under this Section.
7 (c) During the time that tickets are sold for the
8Alzheimer's care, support, education, and awareness
9scratch-off game, the Department shall not unreasonably
10diminish the efforts devoted to marketing any other instant
11scratch-off lottery game.
12 (d) The Department may adopt any rules necessary to
13implement and administer the provisions of this Section.

16 Section 99. Effective date. This Act takes effect upon
17becoming law.
