Bill Title: Amends the Environmental Protection Act. Provides that no owner or operator of a sanitary landfill that is located within a 25-mile radius of an eligible shingle recycling facility (currently, a site where asphalt roofing shingles are recycled under a Beneficial Use Determination pursuant to specified provisions of the Act) shall accept for disposal loads of whole or processed asphalt roofing shingles. Makes a corresponding change. Defines "eligible shingle recycling facility". Removes language providing that provisions concerning the disposal of asphalt roofing shingles are repealed on February 1, 2018.

2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:

4 | Section 5. The Environmental Protection Act is amended by | |||||||||||||||||||
5 | changing Section 22.54a as follows:

8 | Sec. 22.54a. Disposal of asphalt roofing shingles. No owner | |||||||||||||||||||
9 | or operator of a sanitary landfill that is located within a | |||||||||||||||||||
10 | 25-mile radius of an eligible shingle recycling facility a site | |||||||||||||||||||
11 | where asphalt roofing shingles are recycled under a Beneficial | |||||||||||||||||||
12 | Use Determination (BUD) issued by the Agency pursuant to | |||||||||||||||||||
13 | Section 22.54 of this Act shall accept for disposal loads of | |||||||||||||||||||
14 | whole or processed asphalt roofing shingles. Nothing in this | |||||||||||||||||||
15 | Section shall prohibit or restrict a sanitary landfill from | |||||||||||||||||||
16 | accepting for disposal asphalt roofing shingles that are | |||||||||||||||||||
17 | commingled with municipal waste, including, but not limited to, | |||||||||||||||||||
18 | general construction or demolition debris. | |||||||||||||||||||
19 | For the purposes of this Section, "eligible shingle | |||||||||||||||||||
20 | recycling facility" means a site that (1) is approved for | |||||||||||||||||||
21 | asphalt shingle recycling under a Beneficial Use Determination | |||||||||||||||||||
22 | (BUD) pursuant to Section 22.54 of this Act; (2) is in | |||||||||||||||||||
23 | compliance with the provisions of its BUD; (3) is approved for |

1 | the acceptance of asphalt roofing shingles from more than a | ||||||
2 | single source; and (4) is actively accepting asphalt roofing | ||||||
3 | shingles for recycling purposes. The Agency shall post on its | ||||||
4 | website the name and address of each eligible shingle recycling | ||||||
5 | facility site at which the recycling of asphalt roofing | ||||||
6 | shingles under a BUD is approved . | ||||||
7 | No later than January 31 of each year, each recipient of a | ||||||
8 | BUD for asphalt roofing shingles shall submit a report to the | ||||||
9 | Agency that contains the following information: (i) the total | ||||||
10 | quantity of asphalt roofing shingles received under the BUD | ||||||
11 | during the previous calendar year; (ii) the beneficial uses | ||||||
12 | during the previous calendar year of shingles received under | ||||||
13 | the BUD; (iii) the total quantity of shingles used in each | ||||||
14 | beneficial use during the previous calendar year; and (iv) the | ||||||
15 | total quantity and disposition of any shingles received but not | ||||||
16 | beneficially used under the BUD during the previous calendar | ||||||
17 | year. The report must be submitted on a form and in a format | ||||||
18 | prescribed by the Agency. | ||||||
19 | This Section is repealed on February 1, 2018.
