Bill Title: Amends the Mobile Home Landlord and Tenant Rights Act. Provides that in the event of the sale of abandoned or repossessed property, the park owner shall pay lienholders before paying any remaining balance to the title holder of the abandoned or repossessed property. SYNOPSIS AS INTRODUCED:
765 ILCS 745/9.5

Amends the Mobile Home Landlord and Tenant Rights Act. Provides that in the event of the sale of abandoned or repossessed property, the park owner shall pay lienholders before paying any remaining balance to the title holder of the abandoned or repossessed property. Provides that an action by a park owner involving an abandoned or repossessed manufactured home and any household goods or other personal property shall comply with the Abandoned Mobile Home Act. Effective immediately.

1 AN ACT concerning civil law.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Mobile Home Landlord and Tenant Rights Act
5is amended by changing Section 9.5 as follows:
6 (765 ILCS 745/9.5)
7 Sec. 9.5. Abandoned or Repossessed Properties. In the event
8of the sale of abandoned or repossessed property, the park
9owner shall, after payment of all outstanding rent, fees,
10costs, and expenses to the community, and payment in priority
11order to lienholders, including providers of any utility
12services, pay any remaining balance to the title holder of the
13abandoned or repossessed property. If the tenant cannot be
14found through a diligent inquiry after 90 days, then the funds
15shall be forfeited. As used in this Section, "diligent inquiry"
16means sending a notice by certified mail to the last known
17address.
18 An action by a park owner involving an abandoned
19manufactured home and any household goods or other personal
20property in the abandoned manufactured home following an
21eviction shall comply with the Abandoned Mobile Home Act. For a
22repossessed manufactured home, a park owner shall comply with
23subsection (g) of Section 10.1 of the Abandoned Mobile Home Act
