Bill Title: Reinserts the bill as amended by Senate Amendment 1 with the following changes: Makes changes to the membership of the task force. Provides that the task force shall elect a chairperson from its membership and shall have the authority to determine its meeting schedule, hearing schedule, and agendas. Effective immediately.

1 AN ACT concerning regulation.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Insurance Code is amended by adding
5Section 370c.2 as follows:
6 (215 ILCS 5/370c.2 new)
7 Sec. 370c.2. Task force on disability income insurance;
8parity for behavioral health conditions.
9 (a) As used in this Section, "behavioral health condition"
10means any mental, emotional, nervous, or substance use disorder
11or condition that falls under any of the diagnostic categories
12listed in the mental and behavioral disorders chapter of the
13current edition of the International Classification of Disease
14or that is listed in the most recent version of the Diagnostic
15and Statistical Manual of Mental Disorders.
16 (b) The Department shall form a task force to review the
17plans and policies for individual and group short-term and
18long-term disability income insurance issued and offered to
19individuals and employers in this State in order to examine the
20use of such insurance for behavioral health conditions. The
21Task Force shall work cooperatively with the insurance
22industry, community organizations, businesses and business
23coalitions, and advocacy groups to reduce the stigma of

1behavioral health conditions. The task force shall be comprised
2of the following members:
3 (1) 2 representatives of the disability income
4 insurance industry appointed by the Governor.
5 (2) 2 experts in the behavioral health conditions and
6 treatment industry appointed by the Governor.
7 (3) 2 consumers of disability income insurance who have
8 experienced or are experiencing a behavioral health
9 condition appointed by the Governor.
10 (4) One member of the General Assembly appointed by the
11 Speaker of the House of Representatives.
12 (5) One member of the General Assembly appointed by the
13 President of the Senate.
14 (6) One member of the General Assembly appointed by the
15 Minority Leader of the House of Representatives.
16 (7) One member of the General Assembly appointed by the
17 Minority Leader of the Senate.
18 (c) The task force shall elect a chairperson from its
19membership and shall have the authority to determine its
20meeting schedule, hearing schedule, and agendas.
21 (d) Appointments shall be made 90 days after the effective
22date of this amendatory Act of the 101st General Assembly.
23 (e) Members shall serve without compensation and shall be
24adults and residents of Illinois.
25 (f) The task force shall:
26 (1) review existing plans and policies for individual

1 and group short-term and long-term disability income
2 insurance issued, delivered, and offered in the State;
3 (2) compare coverage provided by short-term and
4 long-term disability income insurance policies for
5 behavioral health conditions with coverage provided by
6 such policies for physical conditions and the reasons for
7 differences in coverage;
8 (3) gather information on the cost of requiring
9 individual and group short-term and long-term disability
10 income insurance to cover behavioral health conditions at
11 parity with physical conditions; and
12 (4) provide recommendations on the economic
13 feasibility and cost effectiveness of requiring individual
14 and group short-term and long-term disability income
15 insurance to cover behavioral health conditions.
16 (g) Any of the findings, recommendations, and other
17information determined by the task force to be relevant shall
18be made available on the Department's website.
19 (h) The task force shall submit findings and
20recommendations to the Governor and the General Assembly by
21December 31, 2020.
22 (i) The task force is dissolved and this Section is
23repealed on December 31, 2021.
24 Section 99. Effective date. This Act takes effect upon
25becoming law.
