Bill Title: Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Creates the Advisory Committee on Neonatal Abstinence Syndrome. Provides that the Advisory Committee, in cooperation with the Director of Public Health, shall advise and assist the Department of Public Health in achieving various objectives relating to Neonatal Abstinence Syndrome, including (1) developing a definition of the disease; (2) developing a protocol to identify the disease; (3) identifying and developing methods of training personnel to identify the disease; (4) reporting data to the Department; and (5) making recommendations to the Department to improve outcomes with respect to the disease. Sets forth membership for the Advisory Committee. Requires the Committee to issue yearly reports to the Director of Public Health, the General Assembly, and the Governor by March 31 of each year, beginning in 2016. Provides for a repeal date of June 30, 2019. Effective immediately.

2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:

4 | Section 5. The Department of Public Health Powers and | |||||||||||||||||||
5 | Duties Law of the
Civil Administrative Code of Illinois is | |||||||||||||||||||
6 | amended by adding Section 2310-676 as follows:

7 | (20 ILCS 2310/2310-676 new) | |||||||||||||||||||
8 | Sec. 2310-676. Neonatal Abstinence Syndrome Advisory | |||||||||||||||||||
9 | Committee. | |||||||||||||||||||
10 | (a) As used in this Section: | |||||||||||||||||||
11 | "Department" means the Department of Public Health. | |||||||||||||||||||
12 | "Director" means the Director of Public Health. | |||||||||||||||||||
13 | "Neonatal Abstinence Syndrome" or "NAS" means various | |||||||||||||||||||
14 | adverse conditions that occur in a newborn infant who was | |||||||||||||||||||
15 | exposed to addictive or prescription drugs while in the | |||||||||||||||||||
16 | mother's womb. | |||||||||||||||||||
17 | (b) There is created the Advisory Committee on Neonatal | |||||||||||||||||||
18 | Abstinence Syndrome. The Advisory Committee shall consist of up | |||||||||||||||||||
19 | to 10 members appointed by the Director of Public Health. The | |||||||||||||||||||
20 | Director shall make the appointments within 90 days after the | |||||||||||||||||||
21 | effective date of this amendatory Act of the 99th General | |||||||||||||||||||
22 | Assembly. The members of the Advisory Committee shall represent | |||||||||||||||||||
23 | different racial, ethnic, and geographic backgrounds and |

1 | consist of: | ||||||
2 | (1) at least one member representing a statewide | ||||||
3 | association of hospitals; | ||||||
4 | (2) at least one member representing a statewide | ||||||
5 | organization of pediatricians; | ||||||
6 | (3) at least one member representing a statewide | ||||||
7 | organization of obstetricians; | ||||||
8 | (4) at least one member representing a statewide | ||||||
9 | organization that advocates for the health of mothers and | ||||||
10 | infants; | ||||||
11 | (5) at least one member representing a statewide | ||||||
12 | organization of licensed physicians; | ||||||
13 | (6) at least one member who is a licensed practical | ||||||
14 | nurse, registered professional nurse, or advance practice | ||||||
15 | nurse with expertise in the treatment of newborns in | ||||||
16 | neonatal intensive care units; | ||||||
17 | (7) at least one member representing a local or | ||||||
18 | regional public health agency; and | ||||||
19 | (8) at least one member with expertise in the treatment | ||||||
20 | of drug dependency and addiction. | ||||||
21 | (c) In addition to the membership in subsection (a) of this | ||||||
22 | Section, the following persons or their designees shall serve | ||||||
23 | as ex officio members of the Advisory Committee: the Director | ||||||
24 | of Public Health, the Secretary of Human Services, the Director | ||||||
25 | of Healthcare and Family Services, and the Director of Children | ||||||
26 | and Family Services. The Director of Public Health, or his or |

1 | her designee, shall serve as Chair of the Committee. | ||||||
2 | (d) The Advisory Committee shall meet at the call of the | ||||||
3 | Chair. The Committee shall meet at least 3 times each year and | ||||||
4 | its initial meeting shall take place within 120 days after the | ||||||
5 | effective date of this Act. The Advisory Committee shall advise | ||||||
6 | and assist the Department to: | ||||||
7 | (1) develop an appropriate standard clinical | ||||||
8 | definition of "NAS"; | ||||||
9 | (2) develop a uniform process of identifying NAS; | ||||||
10 | (3) develop protocols for training hospital personnel | ||||||
11 | in implementing an appropriate and uniform process for | ||||||
12 | identifying and treating NAS; | ||||||
13 | (4) identify and develop options for reporting NAS data | ||||||
14 | to the Department by using existing or new data reporting | ||||||
15 | options; and | ||||||
16 | (5) make recommendations to the Department on | ||||||
17 | evidence-based guidelines and programs to improve the | ||||||
18 | outcomes of pregnancies with respect to NAS. | ||||||
19 | (e) The Advisory Committee shall provide an annual report | ||||||
20 | of its activities and recommendations to the Director, the | ||||||
21 | General Assembly, and the Governor by March 31 of each year | ||||||
22 | beginning in 2016. The final report of the Advisory Committee | ||||||
23 | shall be submitted by March 31, 2019. | ||||||
24 | (f) This Section is repealed on June 30, 2019.

25 | Section 99. Effective date. This Act takes effect upon | ||||||
26 | becoming law.
