1 AN ACT concerning safety.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Environmental Protection Act is amended by
5changing Section 26 as follows:
6 (415 ILCS 5/26) (from Ch. 111 1/2, par. 1026)
7 Sec. 26. The The Board may adopt such procedural rules as
8may be necessary to accomplish the purposes of this Act. In
9adopting such rules the Board shall follow the rulemaking
10procedures of the Illinois Administrative Procedure Act.
11 Without limiting the generality of this grant of authority,
12and notwithstanding any requirement that hearings be held in
13actions brought pursuant to Titles VIII and X of the Act, the
14Board may adopt procedural rules for resolution of such actions
15by summary judgment prior to hearing upon motion by either
16party except as otherwise required by federal law, as well as
17procedural rules requiring the parties to perfect their
18pleadings to conform to the evidence as presented to the Board.
