1 AN ACT concerning State government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Department of Public Health Powers and
5Duties Law of the Civil Administrative Code of Illinois is
6amended by adding Section 2310-399.5 as follows:
7 (20 ILCS 2310/2310-399.5 new)
8 Sec. 2310-399.5. Veterans' cancer program.
9 (a) The Department, subject to appropriation or other
10available funding, shall conduct a program to promote awareness
11of cancer in veterans. The program may include, but need not be
12limited to:
13 (1) Dissemination of information regarding the
14 incidence of cancer in veterans, the risk factors
15 associated with cancer, and the benefits of early detection
16 and treatment.
17 (2) Promotion of information and counseling about
18 treatment options.
19 (3) Establishment and promotion of referral services
20 and screening programs.
21 Beginning January 1, 2018, the program must include the
22development and dissemination, through print and broadcast
23media, of public service announcements that publicize the

1importance of cancer screening for veterans.
2 (b) Subject to appropriation or other available funding,
3the Veterans' Cancer Screening Program shall be established in
4the Department of Public Health. The Program shall apply to the
5following persons and entities:
6 (1) uninsured and underinsured veterans; and
7 (2) non-profit organizations providing assistance to
8 persons described in paragraph (1).
9 An entity funded by the Program shall coordinate with other
10local providers of cancer screening, diagnostic, follow-up,
11education, and advocacy services for veterans to avoid
12duplication of effort. Any entity funded by the Program shall
13comply with any applicable State and federal standards
14regarding cancer screening.
15 Administrative costs of the Department shall not exceed 10%
16of the funds allocated to the Program. Indirect costs of the
17entities funded by this Program shall not exceed 12%. The
18Department shall define "indirect costs" in accordance with
19applicable State and federal law.
20 An entity funded by the Program shall collect data and
21maintain records that are determined by the Department to be
22necessary to facilitate the Department's ability to monitor and
23evaluate the effectiveness of the entities and the Program.
24Commencing with the Program's second year of operation, by
25January 1, 2019 and every January 1 thereafter, the Department
26shall submit an annual report to the General Assembly and the

1Governor. The report shall describe the activities and
2effectiveness of the Program and shall include, but not be
3limited to, the following types of information regarding those
4served by the Program: (i) the number; and (ii) the ethnic,
5geographic, and age breakdown.
6 The Department or an entity funded by the Program shall
7collect personal and medical information necessary to
8administer the Program from an individual applying for services
9under the Program. The information shall be confidential and
10shall not be disclosed other than for purposes directly
11connected with the administration of the Program or except as
12otherwise provided by law or pursuant to prior written consent
13of the subject of the information.
14 The Department or any entity funded by the program may
15disclose the confidential information to medical personnel and
16fiscal intermediaries of the State to the extent necessary to
17administer the Program, and to other State public health
18agencies or medical researchers if the confidential
19information is necessary to carry out the duties of those
20agencies or researchers in the investigation, control, or
21surveillance of cancer.
22 The Department shall adopt rules to implement the Veterans'
23Cancer Screening Program in accordance with the Illinois
