1 | AN ACT concerning State government.
| ||||||
2 | Be it enacted by the People of the State of Illinois, | ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Department of Public Health Powers and | ||||||
5 | Duties Law of the
Civil Administrative Code of Illinois is | ||||||
6 | amended by adding Section 2310-399.5 as follows:
| ||||||
7 | (20 ILCS 2310/2310-399.5 new) | ||||||
8 | Sec. 2310-399.5. Veterans' cancer program. | ||||||
9 | (a) The Department, subject to appropriation or other
| ||||||
10 | available funding, shall conduct a program to promote awareness | ||||||
11 | of cancer in veterans. The program may include, but
need not be | ||||||
12 | limited to:
| ||||||
13 | (1) Dissemination of information regarding the | ||||||
14 | incidence of cancer in veterans, the risk factors | ||||||
15 | associated with cancer, and the benefits of early detection | ||||||
16 | and treatment.
| ||||||
17 | (2) Promotion of information and counseling about | ||||||
18 | treatment options.
| ||||||
19 | (3) Establishment and promotion of referral services | ||||||
20 | and screening
programs.
| ||||||
21 | Beginning January 1, 2018, the program must include the | ||||||
22 | development and
dissemination, through print and broadcast | ||||||
23 | media, of public service
announcements that publicize the |

| |||||||
1 | importance of cancer screening for
veterans.
| ||||||
2 | (b) Subject to appropriation or other available funding,
| ||||||
3 | the Veterans' Cancer Screening Program shall be
established in | ||||||
4 | the Department of Public Health. The Program shall apply to the | ||||||
5 | following persons and entities:
| ||||||
6 | (1) uninsured and underinsured veterans; and
| ||||||
7 | (2) non-profit organizations providing assistance to | ||||||
8 | persons described
in paragraph (1).
| ||||||
9 | An entity funded by the Program shall coordinate with other
| ||||||
10 | local providers of cancer screening, diagnostic, follow-up,
| ||||||
11 | education, and advocacy services for veterans to avoid | ||||||
12 | duplication of effort. Any
entity funded by the Program shall | ||||||
13 | comply with any applicable State
and federal standards | ||||||
14 | regarding cancer screening.
| ||||||
15 | Administrative costs of the Department shall not exceed 10%
| ||||||
16 | of the funds allocated to the Program. Indirect costs of the
| ||||||
17 | entities funded by this Program shall not exceed 12%. The
| ||||||
18 | Department shall define "indirect costs" in accordance with
| ||||||
19 | applicable State and federal law.
| ||||||
20 | An entity funded by the Program shall collect data and
| ||||||
21 | maintain records that are determined by the Department to be
| ||||||
22 | necessary to facilitate the Department's ability to monitor and
| ||||||
23 | evaluate the effectiveness of the entities and the Program.
| ||||||
24 | Commencing with the Program's second year of operation, by | ||||||
25 | January 1, 2019 and every January 1 thereafter, the
Department | ||||||
26 | shall submit an annual report to the General Assembly and
the |

1 | Governor. The report shall describe the activities
and | ||||||
2 | effectiveness of the Program and shall include, but not be
| ||||||
3 | limited to, the following types of information regarding those | ||||||
4 | served
by the Program: (i) the number; and (ii) the ethnic, | ||||||
5 | geographic, and age breakdown.
| ||||||
6 | The Department or an entity funded by the Program shall
| ||||||
7 | collect personal and medical information necessary to | ||||||
8 | administer the
Program from an individual applying for services | ||||||
9 | under the Program.
The information shall be confidential and | ||||||
10 | shall not be disclosed
other than for purposes directly | ||||||
11 | connected with the administration of
the Program or except as | ||||||
12 | otherwise provided by law or pursuant to
prior written consent | ||||||
13 | of the subject of the information.
| ||||||
14 | The Department or any entity funded by the program may
| ||||||
15 | disclose the confidential information to medical personnel and | ||||||
16 | fiscal
intermediaries of the State to the extent necessary to | ||||||
17 | administer
the Program, and to other State public health | ||||||
18 | agencies or medical
researchers if the confidential | ||||||
19 | information is necessary to carry out
the duties of those | ||||||
20 | agencies or researchers in the investigation,
control, or | ||||||
21 | surveillance of cancer.
| ||||||
22 | The Department shall adopt rules to implement the Veterans' | ||||||
23 | Cancer
Screening Program in accordance with the Illinois | ||||||
24 | Administrative
