2 | AMENDMENT NO. ______. Amend Senate Bill 277 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The State Officials and Employees Ethics Act is | ||||||
5 | amended by changing Section 20-52 as follows:

6 | (5 ILCS 430/20-52) | ||||||
7 | Sec. 20-52. Release of summary reports. | ||||||
8 | (a) Within 60 days after receipt of a summary report and | ||||||
9 | response from the ultimate jurisdictional authority or agency | ||||||
10 | head that resulted in a suspension of at least 3 days or | ||||||
11 | termination of employment, the Executive Ethics Commission | ||||||
12 | shall make available to the public the report and response or a | ||||||
13 | redacted version of the report and response. The Executive | ||||||
14 | Ethics Commission may make available to the public any other | ||||||
15 | summary report and response of the ultimate jurisdictional | ||||||
16 | authority or agency head or a redacted version of the report |

1 | and response. If the Executive Ethics Commission does not make | ||||||
2 | a summary report and response of the ultimate jurisdictional | ||||||
3 | authority or agency head available to the public, the Executive | ||||||
4 | Inspector General responsible for the investigation and report | ||||||
5 | may make a summary report and response of the ultimate | ||||||
6 | jurisdictional authority or agency head available to the | ||||||
7 | public. | ||||||
8 | (b) The Commission or Executive Inspector General shall | ||||||
9 | redact information in the summary report that may reveal the | ||||||
10 | identity of witnesses, complainants, or informants or if the | ||||||
11 | Commission or Executive Inspector General determines it is | ||||||
12 | appropriate to protect the identity of a person before the | ||||||
13 | report is made public. The Commission or Executive Inspector | ||||||
14 | General may also redact any information it believes should not | ||||||
15 | be made public. Prior to publication by the Commission , the | ||||||
16 | Commission shall permit the respondents, Executive Inspector | ||||||
17 | General, and Attorney General to review documents to be made | ||||||
18 | public and offer suggestions for redaction or provide a | ||||||
19 | response that shall be made public with the summary report. | ||||||
20 | Prior to publication by the Executive Inspector General, the | ||||||
21 | Executive Inspector General shall permit the respondents, the | ||||||
22 | Commission, and the Attorney General to review the documents to | ||||||
23 | be made public and offer suggestions for redaction or provide a | ||||||
24 | response that shall be made public with the summary report. | ||||||
25 | (c) The Commission may withhold publication of the report | ||||||
26 | or response if the Executive Inspector General or Attorney |

2 | interfere with an ongoing investigation.
