Bill Title: Amends the Department of Central Management Services Law of the Civil Administrative Code of Illinois. Requires every institution of higher education approved by the Illinois Student Assistance Commission, whether public or private, to submit an annual report on its voluntary supplier diversity program to the Department of Central Management Services, except that, in the case of public community colleges, requires the report to be submitted to the Illinois Community College Board and requires the Illinois Community College Board to immediately forward the report to the Department. Sets forth provisions on what the report must include and how and when the report must be submitted. Provides that, for each report, the Department shall publish the results on its Internet website for 5 years after submission or, with respect to public community colleges, for 5 years after the report has been forwarded to the Department by the Illinois Community College Board. Requires the Department to hold an annual higher education supplier diversity workshop in February of 2018 and every February thereafter to discuss the reports with representatives of the institutions of higher education and vendors. Provides that the Department shall prepare a template for voluntary supplier diversity reports. Effective immediately.

SYNOPSIS AS INTRODUCED:
20 ILCS 405/405-530 new

Amends the Department of Central Management Services Law of the Civil Administrative Code of Illinois. 1 AN ACT concerning State government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Department of Central Management Services
5Law of the Civil Administrative Code of Illinois is amended by
6adding Section 405-530 as follows:
7 (20 ILCS 405/405-530 new)
8 Sec. 405-530. Higher education supplier diversity report.
9 (a) Every institution of higher education approved by the
10Illinois Student Assistance Commission for purposes of the
11Monetary Award Program, whether public or private, shall submit
12a 2-page report on its voluntary supplier diversity program to
13the Department. The report shall set forth all of the
14following:
15 (1) The name, address, phone number, and e-mail address
16 of the point of contact for the supplier diversity program
17 (or the institution's procurement program if there is no
18 supplier diversity program) for vendors to register with
19 the program.
20 (2) Local and State certifications the institution
21 accepts or recognizes for minority-owned, women-owned, or
22 veteran-owned business status.
23 (3) On the second page, a narrative explaining the

1 results of the report and the tactics to be employed to
2 achieve the goals.
3 (4) With respect to public universities, the voluntary
4 goals, if any, for fiscal year 2018 in each category for
5 the entire budget of the institution (expending both public
6 and private moneys, including any fee-supported entities)
7 and the commodity codes or a description of particular
8 goods and services for the area of procurement in which the
9 institution expects most of those goals to focus on in the
10 next year. With respect to public universities, beginning
11 with the 2019 report, the actual spending for the entire
12 budget of the institution (expending both public and
13 private moneys, including any fee-supported entities) for
14 minority business enterprises, women's business
15 enterprises, and veteran-owned businesses, expressed both
16 in actual dollars and as a percentage of the total budget
17 of the institution. The report shall include the total
18 dollar amount subject to the Business Enterprise Program
19 under the Business Enterprise for Minorities, Females, and
20 Persons with Disabilities Act, the goal established by the
21 Business Enterprise Program, and the actual amount spent on
22 minority-owned, women-owned, and veteran-owned businesses
23 of dollars subject to the Business Enterprise Program goal.
24 The narrative report shall include the university's
25 Compliance Plan as defined by the Business Enterprise
26 Program.

1 (5) With respect to public community colleges, the
2 voluntary goals, if any, for fiscal year 2019 in each
3 category for the entire budget of the institution
4 (expending both public and private moneys, including any
5 fee-supported entities) and the commodity codes or a
6 description of particular goods and services for the area
7 of procurement in which the institution expects most of
8 those goals to focus on in the next year. However, a public
9 community college may report the information under this
10 subdivision (3) for fiscal year 2018 instead. With respect
11 to public community colleges, beginning with the 2020
12 report, the actual spending for the entire budget of the
13 institution (expending both public and private moneys,
14 including any fee-supported entities) for minority
15 business enterprises, women's business enterprises, and
16 veteran-owned businesses, expressed both in actual dollars
17 and as a percentage of the total budget of the institution.
18 However, if a public community college elects to report the
19 information under subdivision (3) of this subsection (a)
20 for fiscal year 2018 instead, then the information under
21 this subdivision (4) must be reported beginning with the
22 2019 report.
23 (6) With respect to private institutions of higher
24 education, the voluntary goals, if any, for either fiscal
25 year or calendar year 2019 in each category for the entire
26 budget of the institution (expending both public and

1 private moneys, including any fee-supported entities) and
2 the commodity codes or a description of particular goods
3 and services for the area of procurement in which the
4 institution expects most of those goals to focus on in the
5 next year. However, a private institution of higher
6 education may report the information under this
7 subdivision (3) for fiscal year or calendar year 2018
8 instead. With respect to private institutions of higher
9 education, beginning with the 2020 report, the actual
10 spending for the entire budget of the institution
11 (expending both public and private moneys, including any
12 fee-supported entities) for minority business enterprises,
13 women's business enterprises, and veteran-owned
14 businesses, expressed both in actual dollars and as a
15 percentage of the total budget of the institution. However,
16 if a private institution of higher education elects to
17 report the information under subdivision (3) of this
18 subsection (a) for fiscal year or calendar year 2018
19 instead, then the information under this subdivision (4)
20 must be reported beginning with the 2019 report.
21 Each public university is required to submit a searchable
22Adobe PDF report to the Department on or before November 15,
232018 and on or before November 15 every year thereafter. Each
24private institution of higher education is required to submit a
25searchable Adobe PDF report to the Department on or before
26November 15, 2019 and on or before November 15 every year

1thereafter. Each public community college is required to submit
2a searchable Adobe PDF report to the Illinois Community College
3Board on or before November 15, 2019 and on or before November
415 every year thereafter. However, if a private institution of
5higher education or public community college elects to report
6the information under subdivision (3) of this subsection (a)
7for fiscal year or calendar year 2018 instead, then the
8institution is required to submit the report on or before
9November 15, 2018 and on or before November 15 every year
10thereafter. The Illinois Community College Board shall
11immediately forward to the Department all reports submitted to
12the Illinois Community College Board. The Illinois Community
13College Board is not responsible for collecting the reports or
14for the content of the reports.
15 (b) For each report submitted under subsection (a) of this
16Section, the Department shall publish the results on its
17Internet website for 5 years after submission or, with respect
18to public community colleges, for 5 years after the report has
19been forwarded to the Department by the Illinois Community
20College Board. The Department is not responsible for collecting
21the reports or for the content of the reports.
22 (c) The Department shall hold an annual higher education
23supplier diversity workshop in February of 2018 and every
24February thereafter to discuss the reports with
25representatives of the institutions of higher education and
26vendors.

1 (d) The Department shall prepare a one-page template (not
2including the narrative section) for the voluntary supplier
3diversity reports. For purposes of complying with the Business
4Enterprise for Minorities, Females, and Persons with
5Disabilities Act and notwithstanding any law to the contrary,
6the submission of these reports by public universities
7satisfies all reporting requirements.
8 Section 99. Effective date. This Act takes effect upon
9becoming law.
