HOUSE JOINT RESOLUTION
2 WHEREAS, The State of Illinois seeks to support development
3that enhances agriculture, industry, public safety, and the
4overall economy of Illinois; and
5 WHEREAS, Levees protect against reoccurring flood damage
6and have the ability to block wide floodplains and displace
7floodwater; and
8 WHEREAS, Permitting processes should be straightforward
9and timely so that lawful and responsible economic growth can
10be feasibly accomplished while preserving the goal of this
11State to protect the people of Illinois from unmitigated flood
12damages caused by others; and
13 WHEREAS, State regulatory processes should consider the
14regulatory processes of federal agencies, especially the U.S.
15Army Corps of Engineers and the federal Emergency Management
16Agency, to minimize the burden of meeting conflicting technical
17requirements between agencies; therefore, be it
18 RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
19NINETY-EIGHTH GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE
20SENATE CONCURRING HEREIN, that we urge the Illinois Department
21of Natural Resources to develop amendments to Part 3700 of

1Title 17 of the Illinois Administrative Code for consideration
2of the Joint Committee on Administrative Rules that:
3 (1) better define the flood risk associated with levee
4 construction by adjusting the upper regulatory limit for a
5 worst-case analysis to be the flood discharge with a 0.2%
6 annual chance of exceedance (500-year frequency) for
7 levees and floodwalls;
8 (2) create uniform technical policies, when applicable
9 and appropriate, with those imposed by other regulatory
10 agencies at the federal, State, and local levels; and
11 (3) create standards for responding to application
12 submissions in a timely manner with identification of
13 requirements for necessary submissions to demonstrate
14 compliance with administrative rules; and be it further
15 RESOLVED, That a suitable copy of this resolution be
16delivered to the Director of Natural Resources.
