Bill Title: Amends the Military Code of Illinois and the Service Member's Employment Tenure Act. Provides that a person in military service enrolled in any Illinois public university, college, or community college who is unable, due to being placed into a period of military service, to attend classes or submit coursework shall not receive a failing grade for examinations or coursework missed during his or her military service. Provides that the faculty and administrative officials of the higher education institution shall make available to the person an equivalent opportunity to make up any examination or coursework he or she may have missed due to his or her military service.

1 | AN ACT concerning veterans.

2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||||
3 | represented in the General Assembly:
| ||||||||||||||||||||||||||
4 | Section 5. The Military Code of Illinois is amended by | ||||||||||||||||||||||||||
5 | changing Section 30.30 as follows:
| ||||||||||||||||||||||||||
6 | (20 ILCS 1805/30.30)
| ||||||||||||||||||||||||||
7 | Sec. 30.30. School attendance and tuition. Any person in
| ||||||||||||||||||||||||||
8 | federal active duty under Title 10 of the United States Code, | ||||||||||||||||||||||||||
9 | or in
training or duty under Title 32 of the United States | ||||||||||||||||||||||||||
10 | Code, or in
State Active Duty,
pursuant to the orders of the | ||||||||||||||||||||||||||
11 | Governor has the
right to receive a full
monetary credit or | ||||||||||||||||||||||||||
12 | refund for
funds paid
to any
Illinois public university, | ||||||||||||||||||||||||||
13 | college, or community college if the person is
placed into a | ||||||||||||||||||||||||||
14 | period of military
service with the State of Illinois pursuant | ||||||||||||||||||||||||||
15 | to the orders of the Governor and
is unable to attend the | ||||||||||||||||||||||||||
16 | university or college for a period of 7 or
more days.

17 | Withdrawal from the course shall not impact upon the final
| ||||||||||||||||||||||||||
18 | grade point average of the person. If any person who has been | ||||||||||||||||||||||||||
19 | enrolled in any
Illinois public university, college, or | ||||||||||||||||||||||||||
20 | community college is unable to process
his or her enrollment | ||||||||||||||||||||||||||
21 | for the upcoming
term, he or she shall have any and all late | ||||||||||||||||||||||||||
22 | penalties and or charges set aside,
including any and all late | ||||||||||||||||||||||||||
23 | processing fees for books, lab fees, and all
items that were |

1 | not in place because the person was engaged in military service
| ||||||
2 | and was unable to enroll in the courses at the appropriate | ||||||
3 | time. | ||||||
4 | Any person in
federal active duty under Title 10 of the | ||||||
5 | United States Code, or in
training or duty under Title 32 of | ||||||
6 | the United States Code, or in
State Active Duty,
pursuant to | ||||||
7 | the orders of the Governor, enrolled in any
Illinois public | ||||||
8 | university, college, or community college who is unable, due to | ||||||
9 | being placed into a period of military service, to attend | ||||||
10 | classes or submit coursework shall not receive a failing grade | ||||||
11 | for examinations or coursework missed during his or her | ||||||
12 | military service. The faculty and administrative officials of | ||||||
13 | the higher education institution shall make available to the | ||||||
14 | person an equivalent opportunity to make up any examination or | ||||||
15 | coursework he or she may have missed due to his or her military | ||||||

17 | The rights
set forth in this Section are in addition to | ||||||
18 | any rights afforded to persons in
military service with the | ||||||
19 | State of Illinois pursuant to the orders of the
Governor under | ||||||
20 | the policies of an Illinois public university, college, or
| ||||||
21 | community college.

with the State of Illinois or in federal | ||||||
4 | active duty service pursuant to the orders of the President of | ||||||
5 | the United States or the Governor has the right
to receive a | ||||||
6 | full
monetary credit or refund for
funds paid
to any
Illinois | ||||||
7 | public university, college or community college if the person | ||||||
8 | is placed into a period of military service pursuant to the | ||||||
9 | orders of the President of the United States or the Governor | ||||||
10 | and
is unable to attend the university or college for a period | ||||||
11 | of 7 or
more days.
Withdrawal from the course shall not impact | ||||||
12 | upon the final
grade point average of the person. If any person | ||||||
13 | who has been enrolled in any
Illinois public university, | ||||||
14 | college, or community college is unable to process
his or her | ||||||
15 | enrollment for the upcoming
term, he or she shall have any and | ||||||
16 | all late penalties and or charges set aside,
including any and | ||||||
17 | all late processing fees for books, lab fees, and all
items | ||||||
18 | that were not in place because the person was engaged in | ||||||
19 | military service
and was unable to enroll in the courses at the | ||||||
20 | appropriate time. | ||||||
