Bill Title: Amends the Civil Administrative Code of Illinois (Department of Transportation Law). Provides that whenever the Department of Transportation has deemed a vehicle has exhausted its useful life (rather than merely deemed it shall be replaced), certain notification procedures are required. Provides that the Department shall make the vehicle available for purchase by the public, including units of local government, through an auction (rather than a sealed bid sale). Provides for the use of proceeds from the sale of Department vehicles. Defines "units of local government".

| 1 | AN ACT concerning State government.

| 2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
| 3 | represented in the General Assembly:

| 4 | Section 5. The Department of Transportation Law of the
| |||||||||||||||||||
| 5 | Civil Administrative Code of Illinois is amended by changing | |||||||||||||||||||
| 6 | Section 2705-575 as follows:
| |||||||||||||||||||

| 8 | Sec. 2705-575. Sale of used vehicles. Whenever the | |||||||||||||||||||
| 9 | Department has deemed a vehicle has exhausted its useful life | |||||||||||||||||||
| 10 | and shall be replaced, it shall notify the Division of Property | |||||||||||||||||||
| 11 | Control of the Department of Central Management Services and | |||||||||||||||||||
| 12 | the Division of Vehicles of the Department of Central | |||||||||||||||||||
| 13 | Management Services for potential reallocation of the vehicle | |||||||||||||||||||
| 14 | to another State agency through inter-agency transfer per | |||||||||||||||||||
| 15 | standard fleet vehicle allocation procedures. If the vehicle is | |||||||||||||||||||
| 16 | not re-allocated for use into the State fleet or agencies by | |||||||||||||||||||
| 17 | the Division of Property Control or the Division of Vehicles of | |||||||||||||||||||
| 18 | the Department of Central Management Services, the Department | |||||||||||||||||||
| 19 | shall make the vehicle available for purchase by the public, | |||||||||||||||||||
| 20 | including, but not limited to, to those units of local
| |||||||||||||||||||
| 21 | government that have previously
requested the notification | |||||||||||||||||||
| 22 | through an auction and provide them the opportunity to purchase | |||||||||||||||||||
| 23 | the vehicle through a sealed bid sale. Any proceeds from the | |||||||||||||||||||

| |||||||
| 1 | sale of a Department vehicle the vehicles to
units of local | ||||||
| 2 | government shall be deposited in the Road Fund, and used as | ||||||
| 3 | provided in Section 8.3 of the State Finance Act. The term
| ||||||
| 4 | "vehicle" as used in this Section is defined to include
| ||||||
| 5 | passenger automobiles, light duty
trucks, heavy duty trucks, | ||||||
| 6 | and other self-propelled motorized equipment in excess of 25 | ||||||
| 7 | horsepower and attachments. The term "units of local | ||||||
| 8 | government", as used in this Section, has the meaning ascribed | ||||||
| 9 | to it in Section 1 of Article VII of the Illinois Constitution, | ||||||
| 10 | and also includes entities named in Section 7b of the State | ||||||
| 11 | Property Control Act.
