Bill Title: Amends the Fish and Aquatic Life Code. Provides that an individual who knowingly imports any nuisance organism into this State is guilty of a Class C misdemeanor or a fine not exceeding $1,500 per organism imported, with a maximum fine not exceeding $25,000. Defines "nuisance organism" as a nonnative aquatic organism that will foreseeably alter and threaten to harm the ecosystem or the abundance and diversity of native or naturalized fish and other organisms.

1 | AN ACT concerning fish.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Fish and Aquatic Life Code is amended by | ||||||
5 | changing Section 10-100 as follows:
| ||||||
6 | (515 ILCS 5/10-100) (from Ch. 56, par. 10-100)
| ||||||
7 | Sec. 10-100. Release of aquatic life. | ||||||
8 | (a) It shall be unlawful to
release any aquatic life
into | ||||||
9 | the wild in this State without first securing permission of the
| ||||||
10 | Department to do so, except that the owner of a body of water | ||||||
11 | may release
aquatic life indigenous to the State of Illinois | ||||||
12 | into waters wholly upon his or her property. The Department | ||||||
13 | shall have the authority to promulgate
necessary rules and | ||||||
14 | regulations, under the Illinois Administrative
Procedure Act, | ||||||
15 | regulating the possession, transportation, and shipping of
| ||||||
16 | aquatic life not indigenous to the State of Illinois. All | ||||||
17 | aquatic life may be
immediately returned unharmed from where | ||||||
18 | they were taken. A violation of this subsection (a) is a Class | ||||||
19 | B misdemeanor.

20 | (b) It is unlawful to possess, transport, or release any | ||||||
21 | live specimen or viable gametes of any species listed as | ||||||
22 | injurious by administrative rule, unless authorized by that | ||||||
23 | rule. A violation of this subsection (b) is a Class A |
