Bill Title: Amends the Illinois Oil and Gas Act. Provides on and after the effective of the bill, a person may not engage in, and the Department of Natural Resources or any other State agency may not issue a permit for, the hydraulic fracturing of a well for exploration or production in the State. Repeals the Hydraulic Fracturing Regulatory Act. Defines "hydraulic fracturing". Effective immediately.

Amends the Illinois Oil and Gas Act. AN ACT concerning regulation.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Illinois Oil and Gas Act is amended by
adding 20.5 as follows:
(225 ILCS 725/20.5 new)
Sec. 20.5. Well drilling; prohibitions.
(a) In this Section, "hydraulic fracturing" means
stimulation treatment performed on oil and natural gas wells in
low-permeability oil or natural gas reservoirs whereby
specially engineered fluids are pumped at high pressure and
rate into the reservoir interval to be treated, causing
fractures to open.
(b) On and after the effective date of this amendatory Act
of the 100th General Assembly, a person may not engage in, and
the Department of Natural Resources or any other State agency
may not issue a permit for, the hydraulic fracturing of a well
for exploration or production in this State.

Section 10. The Hydraulic Fracturing Regulatory Act is
repealed.

Section 99. Effective date. This Act takes effect upon
becoming law.
