Bill Title: Amends the Department of State Police Law of the Civil Administrative Code of Illinois and the State Finance Act. Provides that the Department of State Police shall create and maintain an animal abuse registry. Requires a person 18 years of age or older who resides in or is domiciled in this State and has been convicted of specified offenses involving animal cruelty or torture to register with the Department to be placed on the registry. Requires a person required to register to pay an annual fee of $50 to the Department. Prohibits a person required to register from owning a companion animal or being employed at an animal shelter, pound, pet shop, zoo, or other business where companion animals are present. Creates the Animal Abuse Registry Fund as a special fund in the State treasury. Provides that registration fees shall be deposited into the Fund to be used by the Department for establishing and maintaining the animal abuse registry. Effective immediately.

1 AN ACT concerning animals.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Department of State Police Law of the Civil
5Administrative Code of Illinois is amended by adding Section
62605-331 as follows:
7 (20 ILCS 2605/2605-331 new)
8 Sec. 2605-331. Animal abuse registry.
9 (a) The Department shall create and maintain the animal
10abuse registry. Any person 18 years of age or older who resides
11in or is domiciled in this State and has been convicted of a
12violation of Sections 3.01, 3.02, or 3.03 of this Act shall
13register with the Department within 30 calendar days after the
14date of conviction to be placed on the animal abuse registry.
15 (b) Upon entering a conviction for a violation of Sections
163.01, 3.02, or 3.03 of this Act, the presiding judge shall
17notify the convicted individual of that individual's
18requirement to register under this Section. The clerk of the
19court shall send notice of the conviction and the individual's
20name, date of birth, address, and offense for which he or she
21has been convicted to the Department.
22 (c) Any person required to register under this Section
23shall provide to the Department his or her name, date of birth,

1address, and the offense for which he or she has been
2convicted.
3 (d) Any person required to register under this Section
4shall register annually, and shall continue to register until
5that person receives a court order ordering that the
6registration cease. No court order removing the requirement for
7registration shall be issued until the registrant first
8demonstrates to the court that he or she has undergone
9psychiatric or psychological testing, the result of which
10indicates by clear and convincing evidence his or her capable
11and sound mental capacity and ability to own and properly care
12for an animal in a humane manner. Any person required to
13register under this Section shall notify the Department of any
14name or address change.
15 (e) Any person required to register under this Section
16shall not own a companion animal or have employment at an
17animal shelter, pound, pet shop, zoo, or other business
18establishment where companion animals are present.
19 (f) The animal abuse registry database shall be publicly
20accessible and indexed by name, date of birth, and address. The
21registry shall include the offense for which the registrant has
22been convicted.
23 (g) The Animal Abuse Registry Fund is created as a special
24fund in the State treasury. Any person required to register
25under this Section shall, in addition to any penalty authorized
26by law, pay a mandatory annual fee of $50 to the Department.

1The annual fee shall be deposited into the Animal Abuse
2Registry Fund to be used by the Department for establishing and
3maintaining the animal abuse registry. The Department shall
4establish procedures to document receipt and use of the funds.
5 Section 10. The State Finance Act is amended by adding
6Section 5.886 as follows:

8 Sec. 5.886. The Animal Abuse Registry Fund.
9 Section 99. Effective date. This Act takes effect upon
10becoming law.
