Bill Title: Amends various Acts relating to the governance of public universities in Illinois. Makes changes to the provisions concerning the in-state tuition charge to require that, beginning on July 1, 2026, an individual, other than an individual who has a non-immigrant alien status that precludes an intent to permanently reside in the United States, shall be charged tuition by the governing board of a public university at the same rate as an Illinois resident if the individual meets specified requirements. Provides that the governing board may adopt a policy to implement and administer the provisions and may adopt a policy for the classification of in-state residents, for tuition purposes, based on residency in this State. Provides that the General Assembly finds and declares that the provisions are a State law within the meaning of certain provisions of the United States Code.

4 | Section 5. The University of Illinois Act is amended by | |||||||||||||||||||||||||||||||||||
5 | changing Section 7e-5 as follows:
| |||||||||||||||||||||||||||||||||||
6 | (110 ILCS 305/7e-5) | |||||||||||||||||||||||||||||||||||
7 | Sec. 7e-5. In-state tuition charge. | |||||||||||||||||||||||||||||||||||
8 | (a) Notwithstanding any other provision of law to the | |||||||||||||||||||||||||||||||||||
9 | contrary, for tuition purposes through the 2024-2025 academic | |||||||||||||||||||||||||||||||||||
10 | year , the Board of Trustees shall deem an individual an | |||||||||||||||||||||||||||||||||||
11 | Illinois resident, until the individual establishes a | |||||||||||||||||||||||||||||||||||
12 | residence outside of this State, if all of the following | |||||||||||||||||||||||||||||||||||
13 | conditions are met: | |||||||||||||||||||||||||||||||||||
14 | (1) The individual resided with his or her parent or | |||||||||||||||||||||||||||||||||||
15 | guardian while attending a public or private high school | |||||||||||||||||||||||||||||||||||
16 | in this State. | |||||||||||||||||||||||||||||||||||
17 | (2) The individual graduated from a public or private | |||||||||||||||||||||||||||||||||||
18 | high school or received the equivalent of a high school | |||||||||||||||||||||||||||||||||||
19 | diploma in this State. | |||||||||||||||||||||||||||||||||||
20 | (3) The individual attended school in this State for | |||||||||||||||||||||||||||||||||||
21 | at least 3 years as of the date the individual graduated | |||||||||||||||||||||||||||||||||||
22 | from high school or received the equivalent of a high | |||||||||||||||||||||||||||||||||||
23 | school diploma. |

1 | (4) The individual registers as an entering student in | ||||||
2 | the University not earlier than the 2003 fall semester. | ||||||
3 | (5) In the case of an individual who is not a citizen | ||||||
4 | or a permanent resident of the United States, the | ||||||
5 | individual provides the University with an affidavit | ||||||
6 | stating that the individual will file an application to | ||||||
7 | become a permanent resident of the United States at the | ||||||
8 | earliest opportunity the individual is eligible to do so. | ||||||
9 | This subsection (a) applies only to tuition for a term or | ||||||
10 | semester that begins on or after May 20, 2003 (the effective | ||||||
11 | date of Public Act 93-7) but before the 2025-2026 academic | ||||||
12 | year . Any revenue lost by the University in implementing this | ||||||
13 | subsection (a) shall be absorbed by the University Income | ||||||
14 | Fund. | ||||||
15 | (a-5) As used in this subsection (a-5), "excluded | ||||||
16 | nonimmigrant alien" means an alien identified in 8 U.S.C. | ||||||
17 | 1101(a)(15)(F), 8 U.S.C. 1101(a)(15)(J), or 8 U.S.C. | ||||||
18 | 1101(a)(15)(M). | ||||||
19 | Notwithstanding any other provision of law to the | ||||||
20 | contrary, for tuition purposes beginning with the 2025-2026 | ||||||
21 | academic year, the Board of Trustees shall, at a minimum, deem | ||||||
22 | an individual, other than an excluded nonimmigrant alien, an | ||||||
23 | Illinois resident, until the individual establishes a | ||||||
24 | residence outside of this State, if all of the following | ||||||
25 | conditions are met: | ||||||
26 | (1) The individual attended, on campus, and attained |

1 | credits at any of the following institutions in this | ||||||
2 | State: | ||||||
3 | (A) A public or nonpublic elementary school. | ||||||
4 | (B) A public or nonpublic high school. | ||||||
5 | (C) An adult education program funded by the | ||||||
6 | Illinois Community College Board under the Public | ||||||
7 | Community College Act. | ||||||
8 | (D) A community college organized under the Public | ||||||
9 | Community College Act. | ||||||
10 | (2) The individual satisfies any of the following: | ||||||
11 | (A) The individual graduated from a public or | ||||||
12 | nonpublic high school or received the equivalent of a | ||||||
13 | high school diploma in this State. | ||||||
14 | (B) The individual attained an associate degree | ||||||
15 | from a community college organized under the Public | ||||||
16 | Community College Act. | ||||||
17 | (C) The individual completed a General Education | ||||||
18 | Core Curriculum package under the Illinois | ||||||
19 | Articulation Initiative Act for students transferring | ||||||
20 | from a community college organized under the Public | ||||||
21 | Community College Act. | ||||||
22 | (3) The individual is a current student of or is | ||||||
23 | registering as an entering student in the University. | ||||||
24 | (4) The individual attests, if the individual is not a | ||||||
25 | citizen or a lawful permanent resident of the United | ||||||
26 | States, that the individual will file an application to |

1 | become a permanent resident of the United States at the | ||||||
2 | earliest opportunity the individual is eligible to do so. | ||||||

10 | if a person is on active military duty and is stationed out of | ||||||

12 | years immediately prior to being reassigned out of State, then | ||||||
13 | the Board of Trustees shall deem that person and any of his or | ||||||
14 | her dependents Illinois residents for tuition purposes, as | ||||||
15 | long as that person or his or her dependent (i) applies for | ||||||
16 | admission to the University within 18 months of the person on | ||||||
17 | active military duty being reassigned or (ii) remains | ||||||
18 | continuously enrolled at the University. Beginning with the | ||||||
19 | 2013-2014 academic year, if a person is utilizing benefits | ||||||
20 | under the federal Post-9/11 Veterans Educational Assistance | ||||||
21 | Act of 2008 or any subsequent variation of that Act, then the | ||||||
22 | Board of Trustees shall deem that person an Illinois resident | ||||||
23 | for tuition purposes. Beginning with the 2015-2016 academic | ||||||
24 | year, if a person is utilizing benefits under the federal | ||||||
25 | All-Volunteer Force Educational Assistance Program, then the | ||||||
26 | Board of Trustees shall deem that person an Illinois resident |

2 | year, per the federal requirements for maintaining approval | ||||||
3 | for veterans' education benefits under 38 U.S.C. 3679(c), if a | ||||||
4 | person is on active military duty or is receiving veterans' | ||||||
5 | education benefits, then the Board of Trustees shall deem that | ||||||
6 | person an Illinois resident for tuition purposes for any | ||||||
7 | academic quarter, semester, or term, as applicable. | ||||||

9 | Section 10. The Southern Illinois University Management | ||||||
10 | Act is amended by changing Section 8d-5 as follows:

13 | (a) Notwithstanding any other provision of law to the | ||||||
14 | contrary, for tuition purposes through the 2024-2025 academic | ||||||
15 | year , the Board shall deem an individual an Illinois resident, | ||||||
16 | until the individual establishes a residence outside of this | ||||||
17 | State, if all of the following conditions are met: | ||||||
18 | (1) The individual resided with his or her parent or | ||||||
19 | guardian while attending a public or private high school | ||||||
20 | in this State. | ||||||
21 | (2) The individual graduated from a public or private | ||||||
22 | high school or received the equivalent of a high school | ||||||
23 | diploma in this State. | ||||||

15 | individual, other than an excluded nonimmigrant alien, an | ||||||

12 | Articulation Initiative Act for students transferring | ||||||
13 | from a community college organized under the Public | ||||||
14 | Community College Act. | ||||||
15 | (3) The individual is a current student of or is | ||||||
16 | registering as an entering student in the University. | ||||||
17 | (4) The individual attests, if the individual is not a | ||||||
18 | citizen or a lawful permanent resident of the United | ||||||
19 | States, that the individual will file an application to | ||||||
20 | become a permanent resident of the United States at the | ||||||
21 | earliest opportunity the individual is eligible to do so. | ||||||
22 | Any revenue lost by the University in implementing this | ||||||
23 | subsection (a-5) shall be absorbed by the University Income | ||||||
24 | Fund. | ||||||
25 | (b) If a person is on active military duty and stationed in | ||||||
26 | Illinois, then the Board shall deem that person and any of his |

10 | duty being reassigned or (ii) remains continuously enrolled at | ||||||
11 | the University. Beginning with the 2013-2014 academic year, if | ||||||
12 | a person is utilizing benefits under the federal Post-9/11 | ||||||
13 | Veterans Educational Assistance Act of 2008 or any subsequent | ||||||
14 | variation of that Act, then the Board shall deem that person an | ||||||
15 | Illinois resident for tuition purposes. Beginning with the | ||||||
16 | 2015-2016 academic year, if a person is utilizing benefits | ||||||
17 | under the federal All-Volunteer Force Educational Assistance | ||||||
18 | Program, then the Board shall deem that person an Illinois | ||||||
19 | resident for tuition purposes. Beginning with the 2019-2020 | ||||||
20 | academic year, per the federal requirements for maintaining | ||||||
21 | approval for veterans' education benefits under 38 U.S.C. | ||||||
22 | 3679(c), if a person is on active military duty or is receiving | ||||||
23 | veterans' education benefits, then the Board of Trustees shall | ||||||
24 | deem that person an Illinois resident for tuition purposes for | ||||||
25 | any academic quarter, semester, or term, as applicable. | ||||||

1 | Section 45. The Western Illinois University Law is amended | ||||||
2 | by changing Section 35-88 as follows:

4 | Sec. 35-88. In-state tuition charge. | ||||||
5 | (a) Notwithstanding any other provision of law to the | ||||||
6 | contrary, for tuition purposes through the 2024-2025 academic | ||||||
7 | year , the Board shall deem an individual an Illinois resident, | ||||||
8 | until the individual establishes a residence outside of this | ||||||
9 | State, if all of the following conditions are met: | ||||||
10 | (1) The individual resided with his or her parent or | ||||||
11 | guardian while attending a public or private high school | ||||||
12 | in this State. | ||||||
13 | (2) The individual graduated from a public or private | ||||||
14 | high school or received the equivalent of a high school | ||||||
15 | diploma in this State. | ||||||
16 | (3) The individual attended school in this State for | ||||||
17 | at least 3 years as of the date the individual graduated | ||||||
18 | from high school or received the equivalent of a high | ||||||
19 | school diploma. | ||||||
20 | (4) The individual registers as an entering student in | ||||||
21 | the University not earlier than the 2003 fall semester. | ||||||
22 | (5) In the case of an individual who is not a citizen | ||||||
23 | or a permanent resident of the United States, the | ||||||
24 | individual provides the University with an affidavit |
