410 ILCS 620/25.5 new

Amends the Illinois Food, Drug and Cosmetic Act. Provides that notwithstanding any law to the contrary, no prescription drug that was manufactured in a country other the United States of America may be sold within this State at a price that exceeds 135% of the price for which that drug is sold within the country in which it was manufactured.

1 AN ACT concerning drug prices.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Food, Drug and Cosmetic Act is
5 amended by adding Section 25.5 as follows:
6 (410 ILCS 620/25.5 new)
7 Sec. 25.5. Fair drug pricing. Notwithstanding any law to
8 contrary, no prescription drug that was manufactured in a
9 country other the United States of America may be sold within
10 this State at a price that exceeds 135% of the price for which
11 it is sold within the country in which it was manufactured.
