Bill Title: Amends the Nursing Home Care Act and the Mental Health and Developmental Disabilities Code. Provides that beginning on the effective date of this amendatory Act, there shall be a 2-year moratorium on the enforcement of any new State mandate which would affect facilities or community providers unless such mandate is fully funded through a State appropriation. Effective immediately.

AN ACT concerning regulation.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Nursing Home Care Act is amended by adding
Section 3-808 as follows:
(210 ILCS 45/3-808 new)
Sec. 3-808. Moratorium on State mandate. Beginning on the
effective date of this amendatory Act of the 96th General
Assembly, there shall be a 2-year moratorium on the enforcement
of any new State mandate which would affect facilities or
community providers unless such mandate is fully funded through
a State appropriation.
Section 10. The Mental Health and Developmental
Disabilities Code is amended by adding Section 6-104.5 as
follows:

Sec. 6-104.5. Moratorium on State mandate. Beginning on the
effective date of this amendatory Act of the 96th General
Assembly, there shall be a 2-year moratorium on the enforcement
of any new State mandate which would affect facilities or
community providers unless such mandate is fully funded through

Section 99. Effective date. This Act takes effect upon
becoming law.
