AN ACT concerning public aid.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Illinois Public Aid Code is amended by
changing Section 5-2.1a as follows:
(305 ILCS 5/5-2.1a)
Sec. 5-2.1a. Treatment of trust amounts. To the the extent
required by federal law, the Illinois Department shall provide
by rule for the consideration of trusts and similar legal
instruments or devices established by a person in the Illinois
Department's determination of the person's eligibility for and
the amount of assistance provided under this Article. This
Section shall be enforced by the Department of Human Services,
acting as successor to the Department of Public Aid under the
Department of Human Services Act.
