Bill Title: Amends the Department of Central Management Services Law of the Civil Administrative Code of Illinois. Provides that a State agency may make opioid antagonists available at a location where its employees work if the State agency trains employees in the use and administration of the opioid antagonists. Makes other changes. Amend the Good Samaritan Act. Provides that any employee of a State agency who in good faith administers an opioid antagonist shall not, as a result of her or his acts or omissions, except for willful or wanton misconduct on the part of the employee in administering the drug, be liable for civil damages. Effective January 1, 2025.

1 AN ACT concerning State government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Department of Central Management Services
5Law of the Civil Administrative Code of Illinois is amended by
6changing Section 405-5 and by adding Section 405-545 as
7follows:
8 (20 ILCS 405/405-5) (was 20 ILCS 405/35.2)
9 Sec. 405-5. Definitions.
10 (a) In this Law:
11 "Department" means the Department of Central Management
12Services.
13 "Director" means the Director of Central Management
14Services.
15 (b) In paragraphs (1) and (2) of Section 405-10 and in
16Sections Section 405-15 and 405-545, "State agency", whether
17used in the singular or plural, means all departments,
18officers, commissions, boards, institutions, and bodies
19politic and corporate of the State. The term, however, does
20not mean the judicial branch, including, without limitation,
21the several courts of the State, the offices of the clerk of
22the supreme court and the clerks of the appellate court, and
23the Administrative Office of the Illinois Courts, nor does it

1mean the legislature or its committees or commissions.

4 Sec. 405-545. Opioid antagonists.
5 (a) As used in this Section, "opioid antagonist" has the
6meaning given to that term in Section 5-23 of the Substance Use
7Disorder Act
8 (b) A State agency may make opioid antagonists available
9at a location where its employees work if the State agency
10trains employees in the use and administration of the opioid
11antagonists.
12 (c) An employee of a State agency that uses and
13administrates opioid antagonists as described in this Section
14is exempt from civil liability under Section 69 of the Good
15Samaritan Act.
16 Section 10. The Good Samaritan Act is amended by adding
17Section 69 as follows:

19 Sec. 69. Employees of State agencies; exemptions from
20civil liability for the administration of an opioid
21antagonist. Any employee of a State agency who in good faith
22administers an opioid antagonist, as defined in Section 5-23
23of the Substance Use Disorder Act, in compliance with Section

2of the Civil Administrative Code of Illinois shall not, as a
3result of her or his acts or omissions, except for willful or
