Bill Title: Amends the Illinois Procurement Code. Provides that, if a public institution of higher education or a State agency uses a value-added reseller for the purchase of any information technology hardware under the Code, then that public institution of higher education or State agency may require the value-added reseller to include in its bid an attestation from the manufacturer of the goods stating that the manufacturer offers the goods for sale to all value-added resellers at substantially the same terms that apply to the bidder's purchase of the goods. Requires the Department of Innovation and Technology and the University of Illinois each to include those requirements when making at least one procurement of information technology hardware during State fiscal year 2025. Effective immediately.

1 AN ACT concerning State government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Procurement Code is amended by
5adding Section 55-30 as follows:
6 (30 ILCS 500/55-30 new)
7 Sec. 55-30. Value-added resellers.
8 (a) If a public institution of higher education or a State
9agency uses a value-added reseller for the purchase of any
10information technology hardware under this Code, then that
11public institution of higher education or State agency may
12require the value-added reseller to include in its bid an
13attestation from the manufacturer of the goods stating that
14the manufacturer offers the goods for sale to all value-added
15resellers at substantially the same terms that apply to the
16bidder's purchase of the goods from the manufacturer,
17including price, discounts, commissions, rebates, and other
18incentives that impact the consideration paid for the goods.
19If the public institution of higher education or State agency
20imposes such a requirement, then the specifications for the
21bid must clearly include this requirement.
22 (b) Notwithstanding any other provision of law, the
23Department of Innovation and Technology and the University of

1Illinois must each include the requirements set forth in
2subsection (a) when making at least one procurement of
3information technology hardware during State fiscal year 2025.
4 (c) As used in this Section:
5 "Information technology hardware" means laptops, desktops,
6tablets, monitors, docking stations, telephones, headsets,
7cable cords, computers, servers, and wires.
8 "Public institution of higher education" has the meaning
9given to that term in Section 1-13.
10 "Value-added reseller" means a company that resells
11information technology hardware and provides value, such as
12installation services, software, or service contracts, in
13addition to the original order fulfillment.
