Bill Title: Amends the Environmental Protection Act. Changes the categories of waste that qualify for exemptions from State and local tipping fees and Subtitle D management fees. Amends the Solid Waste Planning and Recycling Act. Requires each county to report its recycling and composting rate and its disposal rate to the Environmental Protection Agency. Establishes a recycling and composting goal that each county waste management plan must satisfy. Amends the Illinois Solid Waste Management Act. Authorizes the Department of Commerce and Economic Opportunity to prepare a resource management plan that contains certain information about recycling and composting in the State. Authorizes the Department to provide grants to counties, municipalities with a population of 1,000,000 or more, and municipal joint action agencies in order to help achieve the recycling and composting goals. Effective immediately.

AMENDMENT TO HOUSE BILL 4986
2 AMENDMENT NO. ______. Amend House Bill 4986, AS AMENDED, by
3replacing everything after the enacting clause with the
4following:
5 "Section 5. The Illinois Solid Waste Management Act is
6amended by adding Section 10 as follows:
7 (415 ILCS 20/10 new)
8 Sec. 10. The Task Force on the Advancement of Materials
9Recycling.
10 (a) The Task Force on the Advancement of Materials
11Recycling is hereby created to review the status of recycling
12and solid waste management planning in Illinois. The goal of
13the Task Force is to investigate and provide recommendations
14for expanding waste reduction, recycling, reuse, and
15composting in Illinois in a manner that protects the
16environment, as well as public health and safety, and promotes

1economic development.
2 The Task Force's review shall include, but not be limited
3to, the following topics: county recycling and waste management
4planning; current and potential policies and initiatives in
5Illinois for waste reduction, recycling, composting, and
6reuse; funding for State and local oversight and regulation of
7solid waste activities; funding for State and local support of
8projects that advance solid waste reduction, recycling, reuse,
9and composting efforts; and the proper management of household
10hazardous waste. The review shall also evaluate the extent to
11which materials with economic value are lost to landfilling,
12and it shall also recommend ways to maximize the productive use
13of waste materials through efforts such as materials recycling
14and composting.
15 (b) The Task Force on the Advancement of Materials
16Recycling shall consist of the following 21 members appointed
17as follows:
18 (1) four legislators, appointed one each by the
19 President of the Senate, the Minority Leader of the Senate,
20 the Speaker of the House of Representatives, and the
21 Minority Leader of the House of Representatives;
22 (2) the Director of the Illinois Environmental
23 Protection Agency, or his or her representative;
24 (3) the Director of Commerce and Economic Opportunity,
25 or his or her representative;
26 (4) two persons appointed by the Director of Commerce

1 and Economic Opportunity to represent local governments;
2 (5) two persons appointed by the Director of the
3 Illinois Environmental Protection Agency to represent a
4 local solid waste management agency;
5 (6) two persons appointed by the Director of the
6 Illinois Environmental Protection Agency to represent the
7 solid waste management industry;
8 (7) one person appointed by the Director of Commerce
9 and Economic Opportunity to represent non-profit
10 organizations that provide recycling services;
11 (8) one person appointed by the Director of Commerce
12 and Economic Opportunity to represent recycling collection
13 and processing services;
14 (9) one person appointed by the Director of Commerce
15 and Economic Opportunity to represent construction and
16 demolition debris recycling services;
17 (10) one person appointed by the Director of Commerce
18 and Economic Opportunity to represent organic composting
19 services;
20 (11) one person appointed by the Director of Commerce
21 and Economic Opportunity to represent general recycling
22 interests;
23 (12) one person appointed by the Director of the
24 Illinois Environmental Protection Agency to represent
25 environmental interest groups;
26 (13) one person appointed by the Director of Commerce

1 and Economic Opportunity to represent environmental
2 interest groups;
3 (14) one person appointed by the Director of the
4 Illinois Environmental Protection Agency to represent a
5 statewide manufacturing trade association; and
6 (15) one person appointed by the Director of Illinois
7 Environment Protection Agency to represent a statewide
8 business association.
9 (c) The Directors of Commerce and Economic Opportunity and
10the Illinois Environmental Protection Agency, or their
11representatives, shall co-chair and facilitate the Task Force.
12 (d) The members of the Task Force shall be appointed no
13later than 90 days after the effective date of this amendatory
14Act of the 97th General Assembly. The members of the Task Force
15shall not receive compensation for serving as members of the
16Task Force, but may be reimbursed for actual expenses incurred
17in the performance of their duties from funds appropriated for
18that purpose.
19 (e) The Task Force shall seek assistance from the Illinois
20Department of Central Management Services, the Illinois Green
21Economy Network, and the Illinois Green Governments
22Coordinating Council to help facilitate the task force, using
23technology, such as video conferencing and meeting space, with
24the goal of reducing costs and greenhouse gas emissions
25associated with travel.
26 (f) The Task Force shall prepare a report that summarizes

1its work and makes recommendations resulting from its study,
2and it shall submit a report of its findings and
3recommendations to the Governor and the General Assembly no
4later than 2 years after the effective date of this amendatory
5Act of the 97th General Assembly.
6 (g) The Task Force, upon issuing the report described in
7subsection (f) of this Section, is dissolved and this Section
8is repealed.".
