Bill Title: Creates the Water Heater Safety Valve Act. Provides that a manufacturer or supplier of a hot water heater for use in a residential home or facility must supply or attach a temperature mixing valve or other safety valve to the hot water heater or tank that prevents water with a temperature above 120 degrees Fahrenheit from coming from any faucet or other source of water into direct contact with a person. Amends the Illinois Plumbing License Law to provide that a person engaged in plumbing who installs a hot water heater for use in a residential home or facility must supply or attach a temperature mixing valve or other safety valve to the hot water heater or tank that prevents water with a temperature above 120 degrees Fahrenheit from coming from any bathtub faucet, shower faucet, sink faucet, or any other source of water into direct contact with a person. Effective January 1, 2021.

New Act
225 ILCS 320/40 from Ch. 111, par. 1138

Creates the Water Heater Safety Valve Act. Provides that a manufacturer or supplier of a hot water heater for use in a residential home or facility must supply or attach a temperature mixing valve or other safety valve to the hot water heater or tank that prevents water with a temperature above 120 degrees Fahrenheit from coming from any faucet or other source of water into direct contact with a person. 1 AN ACT concerning safety.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 1. Short title. This Act may be cited as the Water
5Heater Safety Valve Act.
6 Section 5. Temperature mixing valve or safety valve. A
7manufacturer or supplier of a water heater or tank for use in a
8residence or residential facility located in Illinois must
9supply or attach a temperature mixing valve or other safety
10valve to the water heater or tank that prevents water with a
11temperature above 120 degrees Fahrenheit from coming from any
12bathtub faucet, shower faucet, sink faucet, or any other source
13of water into direct contact with a person.
14 Section 10. Enforcement and administration; civil
15penalties.
16 (a) The Department of Public Health shall administer and
17enforce the provisions of this Act.
18 (b) Any person or entity who violates this Act shall be
19liable for a civil penalty of $500 for the first violation and
20$1,000 for each subsequent violation. The State's Attorney of
21the county in which the violation occurred or the Attorney
22General may bring an action in the circuit court of the county

1in which the violation occurred to enforce the collection of
2any civil penalty imposed.
3 Section 90. The Illinois Plumbing License Law is amended by
4changing Section 40 as follows:
5 (225 ILCS 320/40) (from Ch. 111, par. 1138)
6 Sec. 40. All persons engaged in plumbing as defined in this
7Act shall comply with the minimum code of standards for
8plumbing and the fixtures, materials, design and installation
9methods of plumbing systems published by the Department and
10filed with the Secretary of State as required by this Act.
11 All installations of equipment, fixtures, appliances or
12piping which are used or intended for use entirely for or as a
13part of a water supply system or sewage disposal system and
14thereby can affect the public health shall comply with the
15provisions of the State Plumbing Code for design, materials,
16installation and maintenance. The installation, repair,
17maintenance, alteration or extension of building sewers shall
18be done in accordance with the State Plumbing Code. Any person
19engaged in any of such work shall upon investigation and
20determination of non-compliance with the provisions of the
21State Plumbing Code be subject to the penalties contained in
22this Act. Such prosecution shall be the responsibility of the
23State's Attorney or other authority as authorized by this Act.
