| 1 | AN ACT concerning health.
| |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
| 3 | represented in the General Assembly:

| 4 | Section 5. The Crematory Regulation Act is amended by | |||||||||||||||||||
| 5 | changing Section 7 as follows:
| |||||||||||||||||||

| 10 | Sec. 7. Powers and duties of the Department. Subject to the | |||||||||||||||||||
| 11 | provisions of this Act, the the Department may exercise any of | |||||||||||||||||||
| 12 | the following powers and duties: | |||||||||||||||||||
| 13 | (1) Authorize standards to ascertain the | |||||||||||||||||||
| 14 | qualifications and fitness of applicants for licensing as | |||||||||||||||||||
| 15 | licensed crematory authorities and pass upon the | |||||||||||||||||||
| 16 | qualifications of applicants for licensure. | |||||||||||||||||||
| 17 | (2) Examine and audit a licensed crematory authority's | |||||||||||||||||||
| 18 | records, crematory, or any other aspects of crematory | |||||||||||||||||||
| 19 | operation as the Department deems appropriate. | |||||||||||||||||||
| 20 | (3) Investigate any and all unlicensed activity. | |||||||||||||||||||
| 21 | (4) Conduct hearings on proceedings to refuse to issue | |||||||||||||||||||
| 22 | licenses or to revoke, suspend, place on probation, | |||||||||||||||||||
| 23 | reprimand, or otherwise discipline licensees and to refuse | |||||||||||||||||||
| |||||||
| |||||||
| 1 | to issue licenses or to revoke, suspend, place on | ||||||
| 2 | probation, reprimand, or otherwise discipline licensees. | ||||||
| 3 | (5) Formulate rules required for the administration of | ||||||
| 4 | this Act. | ||||||
| 5 | (6) Maintain rosters of the names and addresses of all | ||||||
| 6 | licensees, and all entities whose licenses have been | ||||||
| 7 | suspended, revoked, or otherwise disciplined. These | ||||||
| 8 | rosters shall be available upon written request and payment | ||||||
| 9 | of the required fee as established by rule.
