Bill Title: Amends the Boat Registration and Safety Act. Provides that no person may operate any motorboat equipped with an engine cut-off switch while the engine is running and the motorboat is underway without verifying that the engine cut-off switch is operational and fully-functional and attaching the engine cut-off switch link to the operator or activating the wireless cut-off system (rather than only requiring that a lanyard engine cut-off switch be attached to the operator on motorboats equipped with a lanyard cut-off switch). Effective immediately.

SYNOPSIS AS INTRODUCED:
625 ILCS 45/4-11 from Ch. 95 1/2, par. 314-11

Amends the Boat Registration and Safety Act. Provides that no person may operate any motorboat equipped with an engine cut-off switch while the engine is running and the motorboat is underway without verifying that the engine cut-off switch is operational and fully-functional and attaching the engine cut-off switch link to the operator or activating the wireless cut-off system (rather than only requiring that a lanyard engine cut-off switch be attached to the operator on motorboats equipped with a lanyard cut-off switch). Effective immediately.

1 AN ACT concerning transportation.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Boat Registration and Safety Act is amended
5 by changing Section 4-11 as follows:
6 (625 ILCS 45/4-11) (from Ch. 95 1/2, par. 314-11)
7 Sec. 4-11. Engine Lanyard cut-off switch.
8 (a) As used in this Section:
9 "Engine cut-off switch link" means the lanyard or wireless
10 cut-off device used to attach the motorboat operator to the
11 engine cut-off switch installed on the motorboat.
12 "Engine cut-off switch" means an operational emergency
13 cut-off engine stop switch installed on a motorboat that
14 attaches to a motorboat operator by an engine cut-off switch
15 link.
16 (b) No person may operate any motor boat, including
17 personal watercraft or specialty prop-craft, which is equipped
18 with an a lanyard type engine cut-off switch while the engine
19 is running and the motorboat is underway without verifying that
20 the engine cut-off switch is operational and fully-functional
21 and:
22 (1) the engine cut-off switch link is properly attached
23 to his or her person, clothing or worn PFD, as appropriate

1 for the specific vessel; or
2 (2) activating the wireless cut-off system.
3 unless such lanyard is properly attached to his or her person,
4 clothing or worn PFD, as appropriate for the specific vessel.

6 Section 99. Effective date. This Act takes effect upon
