Bill Title: Amends the Reimagine Public Safety Act. Provides that, subject to appropriation, the Office of Firearm Violence Prevention shall create a firearm and firearm ammunition buyback program. Provides that, subject to appropriation, the Office of Firearm Violence Prevention shall purchase operable firearms and receive firearm ammunition from the owners of those firearms and firearm ammunition who wish to sell the firearms and transfer the firearm ammunition to the State. Provides that only Illinois residents are eligible to participate in the firearm and firearm ammunition buyback program. Provides that an Illinois resident who sells an operable firearm to the State at the buyback program shall receive $100 per firearm sold. Provides that permanently inoperable or antique firearms are ineligible for the buyback program, except these firearms may be transferred to the Office through the program without compensation. Provides that a person who transfers ammunition, inoperable firearms, or antique firearms to the State at the buyback program shall receive no compensation for transferring ammunition, inoperable firearms, or antique firearms to the State at the buyback program. Provides that firearms and firearm ammunition purchased at the buyback program shall be delivered to the Illinois State Police who may: (1) destroy the firearms; (2) use the firearms for training or other Illinois State Police purposes; or (3) transfer the firearms and firearm ammunition to municipal and county law enforcement agencies for their use. Provides that the Department of Human Services shall adopt rules to implement the program. Effective immediately.

1 AN ACT concerning safety.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Reimagine Public Safety Act is amended by
5adding Section 35-45 as follows:
6 (430 ILCS 69/35-45 new)
7 Sec. 35-45. Firearm and firearm ammunition buyback
8program.
9 (a) In this Section, "firearm" and "firearm ammunition"
10have the meanings ascribed to them in Section 1.1 of the
11Firearm Owners Identification Card Act.
12 (b) Subject to appropriation, the Office of Firearm
13Violence Prevention shall create a firearm and firearm
14ammunition buyback program.
15 (c) Subject to appropriation, the Office of Firearm
16Violence Prevention shall purchase operable firearms and
17receive firearm ammunition from the owners of those firearms
18and firearm ammunition who wish to sell the firearms and
19transfer firearm ammunition to the State. Permanently
20inoperable firearms or antique firearms are ineligible for the
21buyback program, except these firearms may be transferred to
22the Office through the program without compensation.
23 (d) Only Illinois residents are eligible to participate in

1the firearm and firearm ammunition buyback program. An
2Illinois resident who sells an operable firearm to the State
3at the buyback program shall receive $100 per firearm sold. A
4person who transfers ammunition, inoperable firearms, or
5antique firearms to the Office at the buyback program shall
6receive no compensation for the transfer.
7 (e) Firearms and firearm ammunition purchased or
8transferred at the buyback program shall be delivered to the
9Illinois State Police who may:
10 (1) destroy the firearms or firearm ammunition;
11 (2) use the firearms or firearm ammunition for
12 training or other Illinois State Police purposes; or
13 (3) transfer the firearms or firearm ammunition to
14 municipal and county law enforcement agencies for
15 municipal or county use.
16 (f) No person who sells a firearm or transfers firearm
17ammunition, inoperable firearms, or antique firearms at the
18buyback program shall be arrested or prosecuted for such sale
19or transfer of firearms and firearm ammunition at the buyback
20program.
21 (g) The Department of Human Services shall adopt rules to
22implement this program, including the definition of an
23"antique firearm".
24 Section 99. Effective date. This Act takes effect upon
25becoming law.
