Bill Title: Amends the Emergency Telephone System Act and the Emergency Medical Services (EMS) Systems Act. Provides that the corporate authorities of a municipality may not enter into, renew, or extend a contract with a 9-1-1 vendor certified under specified provisions of the Public Utilities Act, provider of emergency services, or emergency vehicle services unless the contract includes a provision requiring written notification of termination by the vendor not less than 12 months prior to termination of services. Provides that if an emergency services contract or dispatch contract is terminated, the provider may not increase the fees of any remaining contract by more than 3% of the fees from the previous year. Effective immediately.

1 | AN ACT concerning local government.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||||
4 | Section 5. The Emergency Telephone System Act is amended | |||||||||||||||||||||
5 | by changing Section 3 as follows:
| |||||||||||||||||||||
6 | (50 ILCS 750/3) (from Ch. 134, par. 33)
| |||||||||||||||||||||
7 | (Section scheduled to be repealed on December 31, 2023)
| |||||||||||||||||||||
8 | Sec. 3.
(a) By July 1, 2017, every local public agency | |||||||||||||||||||||
9 | shall be within the jurisdiction of a 9-1-1 system.

10 | (b) Within 18 months of the awarding of a contract to a | |||||||||||||||||||||
11 | vendor certified under Section 13-900 of the Public Utilities | |||||||||||||||||||||
12 | Act to provide Next Generation 9-1-1 service, every 9-1-1 | |||||||||||||||||||||
13 | system in Illinois, except in a municipality with a population | |||||||||||||||||||||
14 | over 500,000, shall provide Next Generation 9-1-1 service. A | |||||||||||||||||||||
15 | municipality with a population over 500,000 shall provide Next | |||||||||||||||||||||
16 | Generation 9-1-1 service by December 31, 2023. | |||||||||||||||||||||
17 | Notwithstanding any provision of the Illinois Municipal | |||||||||||||||||||||
18 | Code, on or after the effective date of this amendatory Act of | |||||||||||||||||||||
19 | the 102nd General Assembly, the corporate authorities of a | |||||||||||||||||||||
20 | municipality may not enter into, renew, or extend a contract | |||||||||||||||||||||
21 | with a 9-1-1 vendor under Section 13-900 of the Public | |||||||||||||||||||||
22 | Utilities Act unless the contract includes a provision | |||||||||||||||||||||
23 | requiring written notification of termination by the vendor |

5 | (c) Nothing in this Act shall be construed to prohibit or

6 | discourage in any way the formation of multijurisdictional or | ||||||
7 | regional
systems, and any system established pursuant to this | ||||||
8 | Act may include the
territory of more than one public agency or | ||||||
9 | may include a segment of the
territory of a public agency.

11 | Section 10. The Emergency Medical Services (EMS) Systems | ||||||
12 | Act is amended by adding Section 3.260 as follows:

14 | Sec. 3.260. Contracts with municipalities. Notwithstanding | ||||||
15 | any provision of the Illinois Municipal Code, on or after the | ||||||
16 | effective date of this amendatory Act of the 102nd General | ||||||
17 | Assembly, the corporate authorities of a municipality may not | ||||||
18 | enter into, renew, or extend a contract with a 9-1-1 vendor | ||||||
19 | under Section 13-900 of the Public Utilities Act unless the | ||||||
20 | contract includes a provision requiring written notification | ||||||
21 | of termination by the vendor not less than 12 months prior to | ||||||
22 | termination of services. If an emergency services contract is | ||||||
23 | terminated, the provider may not increase the fees of any | ||||||
24 | remaining dispatch contract by more than 3% of the fees from |
