Bill Title: Amends the Public Officer Prohibited Activities Act. Provides that no mayor or alderperson (rather than no alderperson) of any city, or president or member (rather than no member) of the board of trustees of any village, during the term of office for which he or she is elected, may accept, be appointed to, or hold any office or position of compensated employment (rather than only hold any office) by the appointment of the mayor or president of the board of trustees, unless the alderperson or board member is granted a leave of absence from the office, unless he or she first resigns from the office of mayor, president, alderperson, or member of the board of trustees, or unless the holding of another office is authorized by law.

1 | AN ACT concerning local government.
| |||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 5. The Public Officer Prohibited Activities Act is | |||||||||||||||||||
5 | amended by changing Section 2 as follows:
| |||||||||||||||||||

7 | Sec. 2.
No mayor or alderperson of any city, or president | |||||||||||||||||||
8 | or member of the board of trustees of
any village, during the | |||||||||||||||||||
9 | term of office for which he or she is elected, may
accept, be | |||||||||||||||||||
10 | appointed to, or hold any office or position of compensated
| |||||||||||||||||||
11 | employment by the appointment of the mayor
or president of the | |||||||||||||||||||
12 | board of trustees, unless the alderperson or board member
is | |||||||||||||||||||
13 | granted a leave of absence from such office, or unless he or | |||||||||||||||||||
14 | she first
resigns from the office of alderperson or member of | |||||||||||||||||||
15 | the board of trustees,
or unless the holding of another office | |||||||||||||||||||
16 | is authorized by law. The mayor, president, alderperson ,
or | |||||||||||||||||||
17 | board member may, however, serve as a volunteer fireman and

18 | receive compensation for that service. The alderperson may | |||||||||||||||||||
19 | also serve as a commissioner of the Beardstown Regional Flood | |||||||||||||||||||
20 | Prevention District board. Any appointment in violation of | |||||||||||||||||||
21 | this
Section is void.
Nothing in this Act shall be construed to | |||||||||||||||||||
22 | prohibit an elected municipal
official from holding elected | |||||||||||||||||||
23 | office in another unit of local government as
long as there is |

1 | no contractual relationship between the municipality and the
| ||||||
2 | other unit of local government. This amendatory Act of 1995 is | ||||||
3 | declarative of
existing law and is not a new enactment.
