Bill Title: Amends the Public Officer Prohibited Activities Act. Provides that no mayor or alderperson (rather than no alderperson) of any city, or president or member (rather than no member) of the board of trustees of any village, during the term of office for which he or she is elected, may accept, be appointed to, or hold any office or position of compensated employment (rather than only hold any office) by the appointment of the mayor or president of the board of trustees, unless the alderperson or board member is granted a leave of absence from the office, unless he or she first resigns from the office of mayor, president, alderperson, or member of the board of trustees, or unless the holding of another office is authorized by law.

Amends the Public Officer Prohibited Activities Act. 1 AN ACT concerning local government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Public Officer Prohibited Activities Act is
5amended by changing Section 2 as follows:
6 (50 ILCS 105/2) (from Ch. 102, par. 2)
7 Sec. 2. No mayor or alderperson of any city, or president
8or member of the board of trustees of any village, during the
9term of office for which he or she is elected, may accept, be
10appointed to, or hold any office or position of compensated
11employment by the appointment of the mayor or president of the
12board of trustees, unless the alderperson or board member is
13granted a leave of absence from such office, or unless he or
14she first resigns from the office of alderperson or member of
15the board of trustees, or unless the holding of another office
16is authorized by law. The mayor, president, alderperson, or
17board member may, however, serve as a volunteer fireman and
18receive compensation for that service. The alderperson may
19also serve as a commissioner of the Beardstown Regional Flood
20Prevention District board. Any appointment in violation of
21this Section is void. Nothing in this Act shall be construed to
22prohibit an elected municipal official from holding elected
23office in another unit of local government as long as there is

1no contractual relationship between the municipality and the
2other unit of local government. This amendatory Act of 1995 is
3declarative of existing law and is not a new enactment.
