Bill Title: Amends the Firearm Dealer License Certification Act. Provides that the fee amount for a certified licensee shall be based upon the number of firearms sold per year. Provides that if the certified licensee sells less than 150,000 firearms per year, the fee is $200. Provides that if the certified licensee sells 150,000 to 500,000 firearms per year, the fee is $500. Provides that if the certified licensee sells over 500,000 firearms per year, the fee is $1,000.

1 | AN ACT concerning criminal law.

2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:

4 | Section 5. The Firearm Dealer License Certification Act is | ||||||||||||||||||||||||
5 | amended by changing Section 5-70 as follows:

7 | Sec. 5-70. Fees and fines deposited in the Firearm Dealer | ||||||||||||||||||||||||
8 | License Certification Fund. The Department shall set and | ||||||||||||||||||||||||
9 | collect a
fee for each licensee certifying under this Act. The | ||||||||||||||||||||||||
10 | fee amount for a certified licensee shall be based upon the | ||||||||||||||||||||||||
11 | number of firearms sold per year. If the certified licensee | ||||||||||||||||||||||||
12 | sells less than 150,000 firearms per year, the fee is $200. If | ||||||||||||||||||||||||
13 | the certified licensee sells 150,000 to 500,000 firearms per | ||||||||||||||||||||||||
14 | year, the fee is $500. If the certified licensee sells over | ||||||||||||||||||||||||
15 | 500,000 firearms per year, the fee is $1,000. The
fee may not | ||||||||||||||||||||||||
16 | exceed $300 for a certified licensee operating without a

17 | retail location. The fee may not exceed $1,500 for any | ||||||||||||||||||||||||
18 | certified licensee
operating with a retail location.
The | ||||||||||||||||||||||||
19 | Department may not charge a certified licensee in this State, | ||||||||||||||||||||||||
20 | operating under the same or different business name, fees | ||||||||||||||||||||||||
21 | exceeding $40,000 for the certification of multiple licenses. | ||||||||||||||||||||||||
22 | All fees and fines collected under this Act shall be deposited | ||||||||||||||||||||||||
23 | in the Firearm Dealer License Certification Fund which is |

1 | created in the State treasury. Moneys in the Fund shall be used | ||||||
2 | for implementation and administration of this Act.
