Bill Title: Amends the Procurement Code. Requires that on and after January 1, 2016 or as soon thereafter as possible (currently, on or after January 1, 2016), 25% of passenger vehicles (currently, 25% of all vehicles, other than State Police patrol vehicles and Department of Corrections and Secretary of State vehicles), including dedicated or non-dedicated fuel type vehicles, purchased with State funds shall be vehicles fueled by the specified alternative fuels. Provides that the Chief Procurement Officer, in consultation with the Director of Central Management Services, may determine certain State agency vehicle procurements that are exempt from this requirement, based on the specified factors (currently, the Chief Procurement Officer may determine that certain vehicle procurements are exempt based on intended use). Makes related changes.

2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:

4 | Section 5. The Illinois Procurement Code is amended by | ||||||||||||||||||||||||
5 | changing Section 25-75 as follows:

7 | Sec. 25-75. Purchase of motor vehicles. | ||||||||||||||||||||||||
8 | (a) Beginning on the effective date of this amendatory Act | ||||||||||||||||||||||||
9 | of the 94th General Assembly, all gasoline-powered vehicles | ||||||||||||||||||||||||
10 | purchased from State funds must be flexible fuel vehicles. | ||||||||||||||||||||||||
11 | Beginning July 1, 2007, all gasoline-powered vehicles | ||||||||||||||||||||||||
12 | purchased from State funds must be flexible fuel or fuel | ||||||||||||||||||||||||
13 | efficient hybrid vehicles. For purposes of this Section, | ||||||||||||||||||||||||
14 | "flexible fuel vehicles" are automobiles or light trucks that | ||||||||||||||||||||||||
15 | operate on either gasoline or E-85 (85% ethanol, 15% gasoline) | ||||||||||||||||||||||||
16 | fuel and "Fuel efficient hybrid vehicles" are automobiles or | ||||||||||||||||||||||||
17 | light trucks that use a gasoline or diesel engine and an | ||||||||||||||||||||||||
18 | electric motor to provide power and gain at least a 20% | ||||||||||||||||||||||||
19 | increase in combined US-EPA city-highway fuel economy over the | ||||||||||||||||||||||||
20 | equivalent or most-similar conventionally-powered model. | ||||||||||||||||||||||||
21 | (b) On and after the effective date of this amendatory Act | ||||||||||||||||||||||||
22 | of the 94th General Assembly, any vehicle purchased from State | ||||||||||||||||||||||||
23 | funds that is fueled by diesel fuel shall be certified by the |

1 | manufacturer to run on 5% biodiesel (B5) fuel. | ||||||
2 | (b-5) On and after January 1, 2016 , or as soon thereafter | ||||||
3 | as possible , 25% of passenger vehicles, other than Department | ||||||
4 | of Corrections vehicles, Secretary of State vehicles (except | ||||||
5 | for mid-sized sedans), and Department of State Police patrol | ||||||
6 | vehicles, purchased with State funds shall be vehicles fueled | ||||||
7 | by electricity , electricity and gasohol (hybrids or plug-in | ||||||
8 | hybrids) , compressed natural gas, liquid petroleum gas, or | ||||||
9 | liquid natural gas , including dedicated or non-dedicated fuel | ||||||
10 | type vehicles . | ||||||
11 | (c) The Chief Procurement Officer , in consultation with the | ||||||
12 | Director of Central Management Services, may determine that | ||||||
13 | State fleet vehicles utilized by sworn law enforcement | ||||||
14 | personnel engaged in duties of an enforcement nature or other | ||||||
15 | State agency vehicle procurements be exempt from this Section | ||||||
16 | based on availability, overall fleet cost efficiency, fuel | ||||||
17 | economy, intended use, or other reasonable considerations, | ||||||
18 | such as the health and safety of Illinois citizens. | ||||||
19 | (d) The Chief Procurement Officer may determine that | ||||||
20 | certain other vehicle procurements from State funds, such as | ||||||
21 | Constitutional officers and State Universities, are exempt | ||||||
22 | from this Section based on intended use or other reasonable | ||||||
23 | considerations, such as the health and safety of Illinois | ||||||
24 | citizens. certain vehicle procurements are exempt from this | ||||||
