1 | AN ACT concerning safety.
| |||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 1. Short title. This Act may be cited as the | |||||||||||||||||||
5 | Plastic Straw Ban Act.

6 | Section 5. Definitions. In this Act: | |||||||||||||||||||
7 | "Bar" means an establishment that is devoted to the serving | |||||||||||||||||||
8 | of alcoholic beverages for consumption by guests on the | |||||||||||||||||||
9 | premises and that derives no more than 10% of its gross revenue | |||||||||||||||||||
10 | from the sale of food consumed on the premises. "Bar" includes, | |||||||||||||||||||
11 | but is not limited to, taverns, nightclubs, cocktail lounges, | |||||||||||||||||||
12 | adult entertainment facilities, and cabarets. | |||||||||||||||||||
13 | "Department" means the Department of Public Health. | |||||||||||||||||||
14 | "Restaurant" means an establishment, including, but not | |||||||||||||||||||
15 | limited to, coffee shops, cafeterias, sandwich stands, and | |||||||||||||||||||
16 | private and public school cafeterias, that gives or offers for | |||||||||||||||||||
17 | sale food or beverages to the public or guests. | |||||||||||||||||||
18 | "Single-use plastic straw" means a single-use, disposable | |||||||||||||||||||
19 | tube made predominantly of plastic derived from either | |||||||||||||||||||
20 | petroleum or a biologically based polymer, such as corn or | |||||||||||||||||||
21 | other plant sources, used to transfer a beverage from a | |||||||||||||||||||
22 | container to the mouth of the person drinking the beverage. | |||||||||||||||||||
23 | "Single-use plastic straw" does not include a straw made from |

1 | non-plastic materials, including, but not limited to, paper, | ||||||
2 | pasta, sugar cane, wood, or bamboo.

3 | Section 10. Plastic straw ban. No bar, restaurant, or any | ||||||
4 | business that sells food to the public may provide to a | ||||||
5 | customer a single-use plastic straw unless requested by the | ||||||
6 | customer.

7 | Section 15. Enforcement. The Department shall enforce this | ||||||
8 | Act. The first violation of this Act shall result in a notice | ||||||
9 | of violation, and any subsequent violation shall be punishable | ||||||
10 | by a fine of $25 for each day the bar, restaurant, or business | ||||||
11 | is in violation. All fines collected under this Act shall be | ||||||
12 | paid to the Department.
