Bill Title: Amends the Criminal Code of 2012. Creates the offense of abandoning a disabled adult. Provides that a parent or legal guardian of a person who at the time of the offense was a severely or profoundly intellectually disabled person at least 18 years of age commits abandoning a disabled adult when he or she without regard for the mental or physical health, safety, or welfare of the person knowingly leaves the severely or profoundly intellectually disabled person without supervision by a responsible person over the age of 14 for a period of 24 hours or more. Establishes factors the trier of fact shall consider for the purposes of determining whether the severely or profoundly intellectually disabled person was left without regard for the mental or physical health, safety, or welfare of that severely or profoundly intellectually disabled person. Provides that abandoning a disabled adult is a Class 4 felony. Provides that a second or subsequent offense after a prior conviction is a Class 3 felony.

1 | AN ACT concerning criminal law.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 1. Short title. This Act may be cited as the | ||||||
5 | Vulnerable Adults Abandonment Prevention Task Force Act.

6 | Section 5. Vulnerable Adults Abandonment Prevention Task | ||||||
7 | Force Act; members. | ||||||
8 | (a) There is created the Vulnerable Adults Abandonment | ||||||
9 | Prevention Task Force (hereinafter referred to as the Task | ||||||
10 | Force) to address the growing problem of vulnerable adults | ||||||
11 | being left without regard for their mental or physical health, | ||||||
12 | safety, or welfare. The Task Force shall consist of 14 members | ||||||
13 | appointed as follows: | ||||||
14 | (1) 3 members of the Senate appointed by the President | ||||||
15 | of the Senate; | ||||||
16 | (2) 3 members of the Senate appointed by the Minority | ||||||
17 | Leader of the Senate; | ||||||
18 | (3) 3 members of the House of Representatives appointed | ||||||
19 | by the Speaker of the House of Representatives; | ||||||
20 | (4) 3 members of the House of Representatives appointed | ||||||
21 | by the Minority Leader of the House of Representatives; and | ||||||
22 | (5) 2 members appointed by the Governor one of whom | ||||||
23 | shall be designated the chairperson by the Governor.

1 | (b) The members of the Task Force shall serve without | ||||||
2 | compensation but shall be reimbursed for their reasonable and | ||||||
3 | necessary expenses from funds appropriated for that purpose. | ||||||
4 | (c) The State of Illinois Council on Developmental | ||||||
5 | Disabilities shall provide administrative and other support to | ||||||
6 | the Task Force, and the Task Force shall also seek input from | ||||||
7 | the Department of Human Services, the Department on Aging, and | ||||||
8 | the Office of State Guardian. The Task Force shall consult with | ||||||
9 | representatives of law enforcement, bar associations, and | ||||||
10 | not-for-profits focused on persons with developmental | ||||||
11 | disabilities, mental illness, and victims of elder abuse in the | ||||||
12 | preparation of its final report. | ||||||
13 | (d) The Task Force shall conduct a study on the incidence | ||||||
14 | of abandonment of vulnerable adults by persons and entities | ||||||
15 | legally responsible to safeguard the mental or physical health, | ||||||
16 | safety, or welfare of persons who are severely or profoundly | ||||||
17 | intellectually disabled as a result of developmental | ||||||
18 | disabilities, mental illness, dementia, or other similar | ||||||
19 | incapacity and to make recommendations sufficient to protect | ||||||
20 | these vulnerable adults, including the consideration of | ||||||
21 | criminal penalties for the abandonment of these vulnerable | ||||||
22 | adults without assuring adequate support or supervision. | ||||||
23 | (e) On or before January 1, 2014, the Task Force shall | ||||||
24 | report its findings and recommendations to the General | ||||||
25 | Assembly, by filing copies of its report as provided in Section | ||||||
26 | 3.1 of the General Assembly Organization Act, and to the |

2 | (f) The Task Force is abolished on May 31, 2014.
| ||||||
3 | Section 10. Repeal. This Act is repealed on June 1, 2014.
