Bill Title: Amends the Tuberculosis Sanitarium District Act. Provides that a tuberculosis sanitarium district entirely within a county with a population of less than 500,000 may dissolve by resolution of the county board. Further provides that in order to dissolve the district, there must be a county health department servicing the entire county which will assume responsibility for tuberculosis care; the board of directors of the tuberculosis sanitarium district must agree by resolution to be dissolved; and that the resolution of the county board must (1) allow an additional tax not to exceed 0.05% of the value as equalized or assessed by the Department of Revenue for the benefit of the board of health, (2) provide for the transfer of assets and liabilities of the district, (3) provide for the assumption of responsibility for patient care, and (4) provide for an increase in the members on the county board of health.

Amends the Tuberculosis Sanitarium District Act. Provides that a tuberculosis sanitarium district entirely within a county with a population of less than 500,000 may dissolve by resolution of the county board. AN ACT concerning local government.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Tuberculosis Sanitarium District Act is
amended by adding Section 5.3b as follows:
(70 ILCS 920/5.3b new)
Sec. 5.3b. Dissolution of district in a county with a
population of less than 500,000. In counties with a population
of less than 500,000 in which a tuberculosis sanitarium
district exists entirely within the county, a tuberculosis
sanitarium district may be dissolved by resolution of the
county board provided that:
(a) there exists a county or multiple-county health
department serving the entire county and the board of
health of that department has affirmed its willingness to
assume responsibility for the tuberculosis care and
treatment program as indicated by their adoption of a
resolution by a majority vote and transmittal of a copy of
that resolution to the county board and the tuberculosis
district board of directors;
(b) the board of directors of the tuberculosis
sanitarium district by a majority vote adopt a written
resolution recommending to the county board that the

district be dissolved; and
(c) the resolution of the county board also provides:
(1) that an additional tax not to exceed 0.05% of
the value as equalized or assessed by the Department of
Revenue be made available to the board of health, in
addition to that authorized in "An Act in relation to
the establishment and maintenance of county and
multiple-county public health departments", approved
July 9, 1943, which tax shall be collected annually on
all taxable property in the county in like manner with
the general taxes of the county, and which shall be
deposited in the County Health Fund along with other
funds available to the board of health;
(2) that a portion of the additional tax authorized
pursuant to paragraph (1) of this subsection (c), in
the amount determined to be necessary and budgeted by
the county board of health for the control of
tuberculosis, shall be provided by the county board as
a part of the county health department's budget;
(3) that all assets and liabilities of the
tuberculosis sanitarium district be transferred to the
board of health;
(4) that the board of health assume responsibility
for the outpatient care and treatment of individuals
diagnosed as having tuberculosis and for follow-up and
prophylactic treatment of persons who have had contact

with a diagnosed case of tuberculosis consistent with
the rules and regulations of the Illinois Department of
Public Health, but not be responsible for inpatient
treatment; and
(5) that the county board of health be increased
from 8 members to 11 members, the additional 3 members
to be appointed in the same manner as is provided in
Section 13 of "An Act in relation to the establishment
and maintenance of county and multiple-county public
health departments", approved July 9, 1943. The
initial 3 additional members appointed pursuant to
this Section shall be chosen from among the members of
the tuberculosis sanitarium district board dissolved
pursuant to this Section.
